[6. Interoperable Communication in AACOG - Robert Adelman, Chair AACOG Interoperable Communication Subcommittee]

WE'LL MOVE ON TO, UH, ITEM SIX ON THE AGENDA, WHICH IS THE INTEROPERABLE COMMUNICATION IN ACOG, MR. ALDERMAN OR ALMAN.

EXCUSE ME.

ALMAN, RIGHT? YES.

LAST NAME.

GOOD NORM.

UM, JUST A LITTLE BRIEF, UH, FUNNY.

SO CLIFF, UH, TOLD MARCELLE TO MAKE SURE THAT I, UH, KEEP THE PRESENTATION BRIEF.

FOR THOSE OF YOU WHO ACTUALLY KNOW ME, THE WORD BRIEF AND MY NAME ARE MUTUALLY EXCLUSIVE.

, UH, I'M GONNA GIVE IT A I A SHOT.

SO LET'S SEE HERE.

UH, SO I'M LAURA ADAM.

I'M THE CHAIR OF THE INTEROPERABLE COMMUNICATIONS COMMITTEE.

AND SO THIS IS ON THE CURRENT BUILD OUT OF THE AMO AREA RADIO TORONTO BUILDING NETWORK IS AARON.

WE NOW HAVE LOGO, UH, TO REPRESENT THE, UH, THE INITIATIVE.

THERE WE GO.

SO, UH, THE GOALS, UM, ARE, UH, WE'VE SEEN THIS BEFORE, UH, SIMPSON TO BUILD OUT A LAND MOBILE RADIO INTEROPERABILITY LATER ACROSS ACOG AND IN AREAS ADJOINING ACOG, UH, WHERE ACOG MEMBER AGENCIES WILL TYPICALLY RESPOND, RESPOND TO, UH, THINK OF LIKE INTEROPABILITY QUARTERS, UH, TO THE BORDER.

UM, HIGHWAY 93 5, SOUTH CAPITAL, THOSE TYPES OF AREAS, UH, CREATE AN OPERATIONAL FOUNDATION THAT, UH, ACOG MEMBER AGENCIES CAN LEVERAGE TO EITHER ENHANCE THEIR CURRENT SYSTEMS OR IN SOME, SOME CASES IF THEY WANT LEVERAGE

[00:05:01]

IN TECH STOCK'S INVESTMENT AND ACTUALLY REPLACE THEIR EXISTING SYSTEMS. UH, WE'RE OPEN TO THAT.

WE ALSO WANT TO ALSO FOCUS ON ENHANCING PSAP AND BACKUP CAPABILITIES OF LEVERAGING INTERNET.

AND MOST IMPORTANTLY, IMPORTANTLY, TO ACCELERATE THE ADOPTION OF MULTI-BAND RADIOS.

UH, CLIFF LETTER, UM, ALONG THE REFERENCE GUIDE FOR YOU FOLKS AND OTHERS AS WE START LOOKING AT RADIO REPLACEMENTS TO REALLY KIND OF FOCUS, FOCUS ON MULTI-BAND RADIOS THAT GETS, UM, IT'S CONING FRUIT, UH, MULTI VANS, UH, UH, THAT WOULD ALLOW ALL THE RADIO SYSTEMS IN THE AREA, THE PROGRAM, THE RADIO, AND THE USER WOULD BE ABLE TO OBVIOUSLY OPERATE ANYWHERE.

UM, BUT MOST IMPORTANTLY, IT WOULD HELP THEM TO, TO ACTUALLY OPERATIONALIZE, UH, THIS INVESTMENT MAKING IN THIS LAYER.

SO THE OBJECTIVES ARE TO BUILD, BUILD OUT A LAYER WITH DEDICATED INTER INTEROP BUILDING TOP GROUPS ASSIGNED TO ACO.

WE'VE ALREADY DONE NOT THAT.

WE'VE GOT 15 TOP GROUPS ALLOCATED THAT WILL BE, UM, DEPLOYED OVER THE ACCO AREA.

UH, WE'RE ALSO LOOKING TO INTERCONNECT, UM, OTHER AGENCIES, UH, LOCAL SYSTEM, APPLE, MEDINA COUNTY, PERR COUNTY, UH, KIRK COUNTY DEPLOYING A DATA CONNECTED, UH, RADIO SYSTEM.

SO THEY'LL BE PART OF AARON AND MEDINA COUNTY WILL LOOKING TO INTERCONNECT THEIR CURRENT SYSTEM INTO AARON AND WOULD WANT TO DO THE SAME POTENTIALLY WITH OTHER SYSTEMS AS WELL.

WE'RE ALSO LOOKING TO, THIS IS SORT OF HOW WE SORT OF DEVIATE FROM KIND OF THE ORIGINAL GOALS, UM, BECAUSE WE REALLY RECOGNIZE THAT, UM, UH, INTEROPERABILITY IS GREAT, GREAT, BUT IT HAS TO BE OPERATIONALIZED.

IT HAS TO BE USED BY USERS.

SO, UM, UH, THROUGH SOME, YOU'LL SEE IN A MINUTE, SOME, SOME, UH, FUNDING THAT WE GOT.

WE'RE ALSO LOOKING TO INSTALL RADIO, BACKUP UP, RADIO DISPATCH CONSOLES, UM, THAT WILL BE USED, USED ACCESSIBLE BY NOT JUST BEXAR COUNTY, BUT FOR, UM, ALL OF THE 9 1 1 DISTRICTS IN THE COMMON, UH, ACOG'S NINE ONE PROGRAM, AS WELL AS, UH, MEDINA AND S AS WELL.

WE'RE ALSO LOOKING TO REPLACE, UM, ACOG'S ON PREMISE WAVE SYSTEM.

WAVE IS A, YOU KNOW, ABILITY TO USE, UH, F**K ON YOUR PHONE TO THE RADIO SYSTEM, UM, WITH, UH, A NEW VERSION THAT'S, UH, INTERCONNECTED, UH, TO, UH, SEVERAL LARGE IN BEING, UH, IMPLEMENTED AT THE STATE LEVEL.

UM, THAT WILL ULTIMATELY PROVIDE FOR MUCH BETTER COMMUNICATIONS CAPABILITIES.

AND OF COURSE, AS I SAID, UH, DEPLOYING A MULTIFAMILY RADIO.

SO, UM, THIS IS A COLLABORATION, YOU KNOW, THIS, UH, WITH TEXDOT, UM, TDO ALSO JUST RECENTLY, RECENTLY, UH, PUT PEN TO PAPER, UH, AND REFORM INFORMALIZED, THEIR AGREEMENT THEY HAVE WITH THE CITY OF AUSTIN AND TRAVIS COUNTY FOR G UH, ALONG TEXAS DDPS.

SO THEY'RE IN IT FOR THE LONG, LONG HAUL.

NOW, UH, THE BIGGEST BENEFIT THAT PROVIDES, UM, ENTITIES OF ACO WITH AARON IS, IS THAT TYPICALLY GATORS ASSESSES SUBSCRIBER FEES FOR AGENCIES THAT PARTICIPATE, THAT CONNECT TO THEM.

THOSE FEES DON'T EXIST, EXIST FOR US.

OUR RELATIONSHIP WITH IS WITH TDOT.

TDOT OWNS THE RELATIONSHIP WITH, UH, GATORS.

SO, UM, THAT WILL, UH, I THINK SPEED ADOPTION OF, UH, DEPLOYMENT AS WE BUILD THIS OUT.

WE ALSO HAVE QUITE A FEW LOCAL JURISDICTIONS THAT WE'RE LETTING, LEVERAGING THIS EXISTING RELATIONSHIP.

WE, WE HAVE, UM, WE'RE DEPLOYING MULTIUSE AGREEMENTS, MUAS WITH A LOT OF AGENCIES.

UH, KASS COMES TO MIND.

CARNES HAD A 300 FOOT TOWER AT THE SHERIFF'S OFFICE, UH, THAT SAVED US HAVING FIND A TOWER IN THAT, IN THAT COUNTY.

WE'VE EXECUTED IN TECHOPS ACTUALLY EXECUTED MUA WITH THEM.

UH, THAT ALLOWS US TO PUT OUR EQUIPMENT ON THAT TOWER.

UM, TECH STOP WILL SUPPORT IT, UH, ET CETERA.

UH, WE'RE LOOKING AT LOOKING AT MUAS WITH STRAC, UM, FOR SITE HERE IN BEAR COUNTY, WORKING ON ONE OF MENA COUNTY.

AND I MEAN, ULTIMATELY I WOULD SEE MUAS EXECUTED WITH ALL THE COUNTIES OVER A PERIOD OF TIME FOR SHARING OF EQUIPMENT SHARING, OF SITES WORKING TOGETHER.

YOU, YOU KNOW, THE WHOLE COLLABORATION, UH, SHIELD OPERATIONAL BENEFITS, BASICALLY IN A NUTSHELL, IN A NUTSHELL, ACOG IS THE MONEY BAG.

WE GO AFTER THE MONEY, AND WE BUY, WE BUY THE EQUIPMENT, WE PARTNER WITH TDOT.

THEY INSTALL IT, THEY MAINTAIN IT, THEY SUPPORT IT.

UH, THAT'S KIND OF THE RELATIONSHIP.

UM, IN ADDITION, UM, TO THAT, THE OTHER BIG PIECE OF THIS PUZZLE THAT, UM, IS, IS PERHAPS NOW A GREATER BENEFIT, YOU KNOW, PERHAPS WE STARTED THIS INITIATIVE IS SCHOOL SAFETY.

SAFETY.

UM, SO I'M

[00:10:01]

GEEKY, GEEKY OUT HERE, BUT 700 MEGAHERTZ PENETRATE STRUCTURES BETTER THAN DHF.

UH, AND THERE ARE IN-BUILDING COVER SOLUTIONS THAT SCHOOLS CAN PUT IN PLACE THAT GOVERNMENT CAN PUT IN PLACE.

UM, AND THERE ARE A LOT MORE OF THEM, AND THEY ARE CHEAPER AT 700 MEGAHERTZ THAN THEY ARE VHF.

UM, SO, UH, WHILE NOT SCHOOL SAFETY, SAFETY, I'LL USE JUDGE CROSKEY IN LAN AL COUNTY.

SO CU COUNTY HAS A BRAND NEW VHF, UH, RADIO SYSTEM.

AWESOME COVERAGE DOES, THAT'S GREAT.

PROBLEM IS THE SHERIFF'S OFFICE DETERMINED THAT, HEY, WE GO INSIDE THE COURTROOM, UH, IN THE COURTHOUSE OR THE JAIL.

WE HAVE SOME COVERAGE PROBLEMS. WELL, THERE'S A TOWER SITE, ONE OF OUR ERR SITES IN NEW BRAUNFELS.

AND SURE ENOUGH, THAT SITE PROVIDES GREAT COVERAGE INSIDE THOSE TRUCTURE.

SO SHERIFF'S OFFICE AND EX ARE WORKING TOGETHER TO HAVE THEIR CHANNELS, UM, ESSENTIALLY MIRRORED ON EACH OTHER'S SYSTEMS. SO THE SHERIFF'S OFFICE STILL MAINTAIN COVERAGE AND, AND COMMUNICATIONS WITH THEIR DISPATCH CENTER.

BUT WHEN THEY WALK INTO THOSE BUILDINGS, THEY'RE ACTUALLY TALKING ON THE TECH DOCK, UH, NEW BRAUNFELS SIDE.

UH, THE OTHER BIG BENEFIT IS, IS THAT FOR ALL THE RADIO SYSTEMS, UM, UM, AARON ESSENTIALLY PROVIDES A GEOGRAPHIC SYSTEMATIC WIDE REDUNDANCY.

UM, SO ALL OF THE AGENCIES THAT USE LCA FOR THEIR RADIO SYSTEM, THE SAN ANTONIO, ANTONIO BEAR COUNTY AOR, AIR REGIONAL RADIO SYSTEM, AND ALL THE VHF CONVENTIONAL SYSTEMS IN THE COP, WE'RE NOT LOOKING TO, AARON'S NOT LOOKING TO REPLACE THOSE SYSTEMS. IF YOU WANT TO, SURE, WE'LL HAVE THOSE DISCUSSIONS, BUT IT PROVIDES REDUNDANCY.

IF SOMETHING CATASTROPHIC WERE TO HAPPEN IN SAY, THE CITY OF KGO, UM, THE CITY OF VILLE WOULD HAVE THE ABILITY TO LEVERAGE AARON AS BACKUP.

UM, UH, SO, SO THAT'S REALLY KIND OF WHAT WE, SO REALLY FROM THAT PERSPECTIVE.

SO FUNDING, HOW, HOW DID TO GET HERE? SO OF COURSE, T STOP BROUGHT A LOT, BROUGHT LOT TO THE TABLE.

THEY BROUGHT SITES, AND AGAIN, THEY'RE FEAST FOR ET CETERA.

WE'VE BEEN VERY SUCCESSFUL.

WE'RE GOING AFTER STATEWIDE EMERGENCY RATE RADIO INFRASTRUCTURE GRANTS, GRANTS FROM THE STATE.

UM, WE, BETWEEN ABOUT THREE, $3.3 MILLION OR SO, WE'VE BEEN THE MOST RECENT, UM, PROJECT.

WE'RE WAITING ON FORMAL CONFIRMATION FROM OOG ON THE AWARD WE'VE BEEN GIVEN KIND OF CONDITIONAL STATUS.

UM, AND OF COURSE THE VICTIM BOY.

UM, THANKS TO CON, UH, CONGRESSMAN GONZALEZ, UH, WHEN WE, THEY APPROACHED US AND WE SUBMITTED A COMMUNITY FUNDED PROJECT LAST YEAR.

UM, WE ROSE TO THE TOP OF THE TOP OF THE LIST.

WE WERE, UH, IT'S A CONGRESSIONAL APPROPRIATION, UM, FUNDED, UH, AND MANAGED UNDER THE DEPARTMENT OF JUSTICE COST OFFICE, A FOUR AND A HALF MILLION DOLLARS, UH, AWARD, UH, TO A COP.

WE DIDN'T HAVE TO COMPETE AGAINST, UM, ALL THE OTHER ENTITIES, IN FACT, UH, ON A LONG LIST OF AWARDS.

UM, UNDER THAT PROGRAM, UH, ACOMS AWARD IS THE HIGHEST ON THE LIST.

UH, MRG IS LIKE 4.3 OR 4.4 MILLION, BUT WE ARE LITERALLY THE HIGHEST RANK, UH, AWARD WISE ON THAT LIST.

SO A BIG KUDOS TO US.

SO WHAT GREAT, SO GREAT, WE GOT THE MONEY.

WHAT DID WE BUY? WHAT ARE WE BUYING? SO T BROUGHT BOUGHT FOUR SITES TO THE EQUATION TO KIND OF START THE FOUNDATION OF THE BUILD OUT TWO AND BEAR ONE, ONE MINA.

UH, THE S FUNDS, THE, THE, UH, FUNDING THAT WE ALREADY HAVE, WE'VE ALREADY PAID FOR ESSENTIALLY, UM, ADDING SIX SITES, UH, TO, TO THE NETWORK.

AND THEN THE CONDITIONAL FUNDING WE'RE WAITING ON FORMAL APPROVAL FROM, FROM WITH WILL FUND THE SITE FROM MCMULLEN COUNTY.

AND ALSO WE'RE GETTING IN THE TOWER NOW A 350 FOOT TOWER TO HELP ACCELERATE THE DEPLOYMENT OF ONE OF THE SITES IN ASCOS COUNTY.

NOW, ONE THING I NEED TO JUST BRIEFLY SAY IS THE SITES ARE VERY FLUID.

UH, 'CAUSE WHAT HAPPENS IS, IS WE SAY WE'RE GONNA PUT A SITE HERE, WE BUY THE SITE, THEN WE FINALLY GET THE, GET THE EQUIPMENT.

AND IN THAT PERIOD OF TIME, UM, WE'VE DEPLOYED A SITE IN TO THAT TO WHERE WE SAID SAID WE'RE GONNA DO IT.

SO WE KIND OF MOVE THE SITES A LITTLE BIT AROUND LIKE SHELL PIECES.

OVERALL, EVERY COUNTY IN THE CO COD IS GONNA GET SITE OR TWO, OR THREE OR FOUR NEEDS.

SO, UM, JUST KEEP THAT IN MIND.

THE COX PRO PROJECT, THE FOUR AND A HALF MILLION, THAT'S THE BIG BOARD THAT'S GONNA BRING, UH, EIGHT, EIGHT SITES TO THE TABLE.

UM, SEVERAL IN ADDITIONAL ONES IN BEAR, IN BEAR COUNTY, UM, AS WELL AS, AS WELL AS, UH, THE OTHER

[00:15:01]

COUNTIES LISTED.

UM, AND, UH, THREE SITES IN RG.

THESE ARE SITES OUTSIDE OF A COGS PRIMARY SERVICE AREA, BUT THEY SUPPORT CORRIDOR OPERATIONS.

SO HIGHWAY 90 WEST, BECAUSE THE REALITY IS UNFORTUNATELY, GOD FORBID, WE HAVE A, YOU KNOW, SCHOOL SHOOTING LIKE ELDERLY OR THERE'S SOMETHING BORDER, THOSE CORRIDORS, ALL THOSE RESOURCES ARE GONNA COME WHERE THE LOGISTICAL HUB STATE, UH, AND OUR RESOURCES NEED TO BE ABLE TO COMMUNICATE, MAINTAIN, UH, COMMUNICATIONS WITH HOME BASE.

SO THAT'S WHY WE'RE BUILDING THAT, THAT WAY.

UH, THIS IS WHERE WE DEVIATE FROM TYPICAL SITES.

SO THE, UH, FUNDING IS ALSO GONNA FUND FOUR DISPATCH RADIO DISPATCH, CONS, POSITION BACKUP CONSULATE AT THE QUARRY, THE BARO FACILITY, UM, THAT WILL DIRECTLY ALLOW, UH, SUPPORT THAT BACKUP CAPABILITIES FOR CON COUNTY, WHO IS A GATOR CONNECTED ENTITY.

ALSO WOULD SUPPORT CAPABILITIES FOR, AND AS ACON CONTINUES TO BUILD THE RELATIONSHIP WITH VERA METRO, THE LEVERAGE THAT SAME FACILITY, ITS NINE ONE PROGRAM.

UH, THESE COUNCILS KIND OF SUPPORT THOSE OPERATIONS.

WE'RE ALSO FUNDING SEVEN, UH, MULTI-BAND THAT'S FOR ASCO IN COUNTY.

THESE CONS LISTS WILL REPLACE WHAT THEY HAVE TODAY, WHICH IS WOE WOEFULLY OUTDATED, UH, AND WILL GIVE THEM THE ABILITY TO COMMUNICATE DIRECTLY WITH, WITH AARON USERS, UM, FOR IMPROVED SITUATIONAL AWARENESS.

WE'RE ALSO GONNA BE FINDING SOME INTERCONNECTIONS TO THE ILLINOIS REGIONAL RADIO SYSTEM TO BRING MORE OF THEIR COUNTY SAN ANTONIO TALK GROUPS AND ALL THE ENTITIES IN THEIR COUNTY INTO THE SYSTEM FOR, UH, UH, COMMUNICATIONS CAPABILITIES.

WE'RE ALSO GONNA BE FUNDING THE INITIAL INVESTMENT, UH, TO ESTABLISH THE CON CONNECTIVITY TO THE CURRENT AND MEDINI COUNTY SYSTEMS THAT THOSE COUNTIES WILL ULTIMATELY BE RESPONSIBLE FOR THE ONGOING COSTS.

WE JUST PROVIDING THE INITIAL OUTLAY TO GET 'EM GOING.

UH, AND AS I STATED BEFORE, PTX MIGRATION, BUT THE BIG BOY, THE BIG BOY IS WE'RE GONNA BE FUNDING 96 MULTI BED RADIOS.

AND THOSE, THOSE ENTITIES, THOSE POLICE DEPARTMENTS, LINE , PEARSON, AND COUNTY WILL GET THOSE RADIOS.

THAT'S A HUGE INVESTMENT.

THERE'S ONLY ALMOST A MILLION DOLLARS RIGHT OFF THE BAT IN RADIOS, UM, BE GOING TO THOSE COUNTIES DOWN, ACCELERATE THEIR DEPLOYMENT.

UM, THE REALITY IS, IS WE'RE GONNA CONTINUE, UNLESS CLIFF TELLS ME, UNLESS TELLS ME TO STOP, WE'RE, WE'RE GONNA CON, WE'RE GONNA CONTINUE TO GO AFTER ANY AND ALL AVAILABLE FUNDING SOURCES TO NOT ONLY BUILD OUT SITES, BUT TO GO AFTER THE MORE, MORE MULTI-BAND RADIOS TO HELP, UM, THOSE COUNTIES IN MECO, UM, ADOPT THIS TECHNOLOGY AND HOPEFULLY PUT THEM ON FOOTING SO THAT THE RIO COUNTY, UH, THE RIO COUNTY MON AND MCMULLEN COUNTY COMMISSIONERS DON'T, DON'T HAVE TO ADDRESS THIS FOR ANOTHER 10 YEARS.

UM, THE REALITY IS, IS THE, THE LARGER AGENCIES LIKE, LIKE SAN ANTONIO OR COUNTY AND UH, THOSE URBAN COUNTIES, THEY ALREADY HAVE MULTI-DAY RADIOS.

UH, FOR THE MOST PART.

UM, THE, THE LOWER HANGING FRUIT ARE THE MORE RURAL COUNTIES LOWER HANGING BECAUSE THEY DON'T HAVE AS MANY PEOPLE, THEY DON'T HAVE AS MANY NEEDS AS THE, AS THE LARGER URBAN COUNTY.

SO, SO IT'S POTENTIALLY MORE ATTAINABLE FOR ACCON TO KIND OF GO, GO AFTER THAT TYPE OF FUNDING.

UM, SO, UM, NOW I'M GONNA SHOW YOU TWO MAPS.

UM, TO GIVE YOU A SENSE, A SENSE OF WHAT WE'RE TALKING ABOUT WITH AIRING COVERAGE.

THIS FIRST MAP IS, UM, BASED ON PORTABLE COVERAGE.

THIS IS WHAT THE GUYS IN THE FIELD USE.

UM, SO THESE ARE THE CURRENT PROPOSED PROPOSED SITES.

UM, UM, THE, ALL OF THE, THE SITES THAT ARE ON THIS LIST, WITH THE EXCEPTION OF THE RED ONES, ARE SITES THAT WE, WE EITHER ALREADY HAVE IN PLAY OR THAT WE'RE BUILDING OUT TO.

SOME OF THE SITES WILL REQUIRE SOME COOPERATIVE AGREEMENTS THAT WE'RE CONTINUING TO WORK FOR VARIOUS COUNTIES.

UM, BUT THIS GIVES YOU A SENSE OF, OF JUST COVERAGE OF THE GUY ON THE, IN THE FIELD.

THE, THE REALITY IS, IS THE NEXT SLIDE I'LL SHOW YOU IN A MINUTE, WILL HOPEFULLY BLOW YOU MIND.

UM, BUT THE ACTUAL COVERAGE FOR A USER IN THE FIELD IS ACTUALLY GONNA BE SOMEWHERE BETWEEN THIS SLIDE AND THE NEXT SLIDE.

THIS, THESE MAPS ARE VERY, VERY CONSERVATIVE, UH, MAPS.

WE'VE ACTUALLY SHOWN THAT A USER LOCKED ONTO TO SAY THAT THE HONDA SITE, UH, UM, I CAN ACTUALLY TALK WELL WITHIN ER COUNTY.

UM,

[00:20:01]

BUT, UM, THE VENDOR'S NOT WILLING TO PUT THEIR NECK OUT ON NECK OUT ON THE LINE.

THIS IS WHAT THEY'RE, THEY KIND OF COMMIT TO TERMS OF COVERAGE.

SO THIS IS PORTABLE COVERAGE AND HE IN A SENSE THAT WE TEND TO FOCUS THE PORTABLE COVERAGE ON THIS BUILD OUT TO WHERE THE MAJOR POPULATION CENTERS ARE OF THE VARIOUS ACCOUNT.

ALRIGHT, SO THIS IS MOBILE COVERAGE.

UH, THIS IS WHAT T STOCK TYPICALLY BUILDS TO BECAUSE AS THE IMPLY THE APARTMENT OF TRANSPORTATION, THEY'RE FOCUSED ON ROADWAYS AND THEIR CREWS USE MOBILE RADIOS.

ACO USES, UH, THE PORT, BUT THIS IS WHAT MOBILE COVERAGE LOOKS LIKE SIGNIFICANTLY.

UM, AND THERE ARE TECHNOLOGY TECHNOLOGIES TO LEVERAGE, UM, MOBILE, MOBILE CAPABILITIES FOR FIRST RESPONDERS AS WELL.

SO IT DOESN'T, THE USER DOESN'T HAVE EVEN BE IN THE CAR TO ANDREW.

YOU CAN GET A SENSE OF HOW MUCH MORE COVERAGE THERE WILL BE.

WE STILL HAVE A LOT MORE BUILD OUT.

WE WANT TO, LIKE I SAID, PUT MORE SITES IN, UM, TO PROVIDE THE COUNTY'S MUCH MORE, MUCH MORE FLEXIBILITY IN TERMS OF, YOU KNOW, THEIR FUTURE.

SO THAT'S, I DON'T KNOW HOW MANY MUCH THAT, BUT THAT WAS PROBABLY 10 MINUTES, BUT THAT WAS CONCISE.

GET INFORMATION, QUESTIONS, COMMENTS, CONCERN, MR. CHAIR? QUESTION? UH, SIR BRIAN HOFFMAN FROM JOINT BASE SAN ANTONIO, I, IS THIS THE PRIMARY MEANS OF COMMUNICATION FOR LAW ENFORCEMENT AND FIRST RESPONDERS? NO, IT'S NOT PRIMARY.

IT'S NOT PRIMARY.

IT'S DESIGNED AS A EMERGENCY.

SECONDARY IS AN INTEROPERABILITY LAYER.

UM, UH, JOINT JOINT, UH, JOINT BASE, SAN JOINT BASED SAN ANTONIO, UM, HAS BEEN IN MY PREVIOUS WITH PER COUNTY, UM, WE WERE VERY MUCH ENGAGED WITH THEM AND THEY WILL, UM, HAVE ACCESS EVERY, EVERY ENTITY, WHETHER YOU ARE A CITY, A COUNTY, A MILITARY BASED, EVERY FIRST RESPONDER MEMBER AGENCY IS COVERED, IS COVERED BY THE UMBRELLA THAT TXO, THAT ACON HAS WITH TTO.

SO EVENTUALLY, UM, THE AIRING LAYER WOULD BE MADE AVAILABLE TO, UH, MILITARY SECURITY FORCES, FORCES TO HAVE IN THEIR RADIOS OR, OR THROUGH THE DISPATCH CENTERS, WHICHEVER, WHICHEVER USED.

APPRECIATE THAT.

ANOTHER QUESTION IS, IS THIS INTENT INTEROPERABILITY AT THE COUNTY LEVEL? THE CITY OR STATE LEVEL OR ALL? ALL, OKAY, GOTCHA.

INCLUDING FEDERAL, FEDERAL, UH, YOU KNOW, THE, THE BIGGEST THING, UH, FOR EXAMPLE, THE, THE SITES IN, IN MRG OUT OF THE HIGHWAY 94 QUARTER, THE BIGGEST CHALLENGE RIGHT NOW IS OF COURSE YOU'VE GOT ALL THE BORDER OPERATIONS GOING ON, RIGHT? SO YOU GOT ALL THE FEDERAL, THE STATE, THE LOCAL, WELL THE, THE FEDS AND STATE DIE ARE OVERLOADING THE, UH, VHF FREQUENCIES IN THOSE COUNTIES AND ACTUALLY IN SOME INTERFERING WITH THE PRODUCTIVITY, PRODUCTIVITY PERFORMANCE OF THE LOCAL, LOCAL GUYS.

UM, SO BY US ACTUALLY DEPLOYING SITES IN ALONG THAT CORRIDOR, THOSE USERS WILL BE ABLE TO OFFLOAD THEIR TRAFFIC TO AARON, UH, AND FREE UP, UP, UM, THAT LOCAL SPECTRUM BEFORE USED BY THE LOCAL AGENCY.

BUT EVERYONE STILL CAN TALK TO, TO, CAN TALK TO FACTS.

WHAT, WHAT I'LL OFFER MR. CHAIR IN THE GROUP IS INTEROPERABILITY IS GREAT.

WHEN YOU BROADEN THAT YOU MIGHT CREATE MORE PROBLEMS UNLESS YOU HAVE VERY STRICT PROTOCOL AND PROCEDURES TO FOLLOW AND YOU LINK IT TO A COMMON OPERATING PICTURE AND PROVIDE GEOSPATIAL INFORMATION AT THE SAME TIME THAT THAT EQUATES TO GOOD COMMAND AND CONTROL DURING AN EMERGENCY.

YES, SIR.

UH, HI, DEREK SCHROEDER, UH, MAYOR OF CASTRO.

SO HOW DOES THAT WORK FUNCTIONALLY? UH, WE JUST HAD A HIGH SPEED CHASE THAT CAME THROUGH TOWN A COUPLE OF WEEKS AGO FROM, UM, FROM SAN ANTONIO, AND I THINK WE HAD TWO OR THREE MINUTES NOTICE.

SO HOW DOES THAT FUNCTIONALLY WORK FOR OUR PEOPLE IN THE FIELD IF WE'RE CONNECTED TO THE SYSTEM? HOW ARE THEY NOTIFIED? BECAUSE THEY'RE NOT ALL TALKING ON THE SAME BAND.

YEAH, WELL, UH, CURRENTLY NO ONE'S USING AARON.

I MEAN, UH, IT'S STILL IN THE VERY EARLY STAGES OF BUILD OUT.

THE ONLY ACTUAL OPERATIONAL OPERATIONAL USERS TODAY HAPPEN TO BE COUNTY SHIP SHERIFF'S OFFICE BECAUSE OF THE NEED FOR THE SITE IN, IN NEW BRAUNFELS.

BUT, UM, THE, THE PLAN AT A HIGH LEVEL, THE PLAN WOULD BE ONCE THERE'S SIGNIFICANT, THE SITES ARE SIGNIFICANT BUILT OUT, START TO LEVERAGE IT.

THE PLAN WOULD BE THE FIRST FOCUS ON THE REGIONAL RESPONDER ENTITIES, THE, THE REGIONAL SWAT TEAMS, BOMB SQUAD AIRCRAFT, UH, THE DISPATCH CENTERS, EMERGENCY MANAGEMENT COORDINATORS, THOSE TYPES OF FOLKS FIRST.

AND THEN WE COME, COME UP WITH SOME SORT OF A STRATEGY OR PLAN TO THEN EVENTUALLY FOLD IN ALL OF THE MEMBER AGENCIES.

UH, THE, UH, MOST LIKELY WHAT WE'LL DO IS MUCH LIKE WE HAVE ON, UH, TODAY, UH, ONE OF THE, ONE OF

[00:25:01]

THE TALK GROUPS ON HERE IS GONNA BE LIKE A REGIONAL, UH, COMMON CHANNEL THAT WILL BASICALLY BE, UH, PAIRED UP THE COMMON CHANNELS THAT WE HAVE TODAY ON THE ALAM MURRAY REGIONAL RADIO RADIO SYSTEM, THE SAN ANTONIO BEAR COUNTY USED.

UM, SO THAT IN THEORY YOU COULD KEY UP ON THAT CHANNEL AND, YOU KNOW, TALK TO, YOU KNOW, YOU'RE GOING OUT TO THE WORLD IN TERMS OF, UH, COMMUNICATION.

UH, THE THINKING ALSO ALSO IS MAYBE WE WOULD HAVE SOME SORT OF LIKE A REGIONAL, UM, CANINE HE HELICOPTER PURSUIT TYPE TYPE CHANNEL THAT COULD BE USED.

UM, UH, BIGGEST THE BIGGEST PIECE OF THE PUZZLE PUZZLE IS, IS WE NEED TO KIND OF, WE'RE GONNA HAVE TO TACKLE HOW WE, UH, INCORPORATE THE DISPATCH CENTER OPERATIONS.

THOSE ARE KIND OF KEY TO THE PROCESS BECAUSE IF THE DISPATCH CENTER CENTERS CAN TALK AND THEY CAN CREATE PATCHES AND DO OTHER THINGS UNTIL SUCH TIME, UNTIL SUCH TIME AS WE HAVE KIND OF BROADER ADOPTION OF, OF, OF USERS ON THE SYSTEM.

I DUNNO IF I ANSWERED YOUR QUESTION, BUT I THINK SO.

SO IT SOUNDS LIKE THE, UM, THE BE COUNTY OR SAN ANTONIO DISPATCH WOULD CONTACT THE MEDINA DISPATCH WOULD THEN CONTACT US? UM, NO, NO.

IDEALLY, UM, THEY WOULD, UH, UM, WELL ONE OF THE, ONE OF THE TOPICS OF THE TALK THAT WE'VE TALKED THAT WE, WE DO WANT TO HAVE A PSAP OR A DISPATCH KIND OF TALK GROUP.

IT CAN BE USED SPECIFIC SPECIFICALLY FOR PSAP COORDINATION SO THAT IF YOUR PSAP, UH, WELL YOUR CAST, RIGHT, RIGHT.

OKAY.

SO YOU MEAN, BUT, UM, SAY MEDINA COUNTY HAD TO EVACUATE.

MEDINA COUNTY COULD, COULD GET UP, COULD SPEAK ON THIS TALK AND NOTIFY THE OTHER DISPATCH CENTERS AROUND THEM THAT THEY'RE HAVING TO ABANDON SHIP.

UM, OR THAT, UM, HEY, THERE'S A, THERE'S A, THERE'S A CHASE INBOUND, UM, UM, THAT'S GONNA BE ENTERING YOUR ACCOUNT.

SO WE WANT TO HAVE A PSAP SPECIFIC TALK GROUP THAT THE PSAPS CAN USE TO COORDINATE AMONGST THEMSELVES, UM, FOR THOSE TYPES OF SCENARIOS.

OKAY, GREAT.

AND THANK YOU, ROBERT.

IF I MAY, UH, MAYOR, WERE YOU, I THINK YOU'RE TALKING ABOUT LIKE THE MECHANICS OF THE ACTUAL CHASE? OR IS THAT YOUR QUESTION? UH, SO WE HAD, LIKE I SAID, TWO OR THREE MINUTES OF NOTICE.

AND SO, UM, I THINK IF I, IF I GET WHERE YOU'RE GOING, I THINK IT GETS TO YOUR COMMON CHANNEL.

THERE'S A COMMON CHANNEL WHERE ONE OFFICER ALL GET ON THAT COMMON CHANNEL AND SAY, YOU KNOW, WHO'S INVOLVED IN THIS? CHASE GO TO GO TO CHANNEL FOUR, WHICH ONE OR H WHATEVER THEY USE.

MAKES SENSE.

OKAY.

AND SO EVERYBODY, UH, AGGREGATES TO THAT CHANNEL, AND THEN THAT'S HOW THEY CAN ALL COMMUNICATE WITH EACH OTHER AND WHAT THAT COMMON CHANNEL IS, YOUR LINK OR DISPATCH.

YEAH, I HAVE VERY LIMITED EXPERIENCE IN THIS, IN THE DA'S OFFICE, BUT I, BUT, BUT I WILL SAY THAT WHAT HE'S TALKING ABOUT IS A LOGISTICAL NIGHTMARE WITHOUT THOSE INTEROPERABILITY CAPABILITIES.

AND I'LL SAY THAT ME COUNTY, SO PART IS PART THIS PLAN IN THE COUNTY TO INTEGRATE ITS CURRENT RADIO SYSTEM INTO AARON.

SO THAT MEANS THE MEDINA COUNTY DISPATCHERS WILL HAVE THE ABILITY TO CREATE AD HOC PATCHES BETWEEN LOCAL TALK GROUPS AND AARON TALK GROUPS.

SO FOLKS COMING IN ON AARON WILL BE ABLE TO TALK TO AND VICE VERSA.

AND YOU WON'T, WON'T EVEN KNOW ABOUT, YOU WON'T EVEN KNOW HOW IT'S DONE.

MEDINA COUNTY WILL HANDLE IT.

NOW THE PLAN IS YOUR RADIOS WOULD HAVE THESE TOP LOOPS IN IT.

AND, YOU KNOW, THANKS TO UH, UH, JUDGE BLUE, UH, I'M HAPPY FOR HIM.

HE KIND OF TORPEDOED ONE OF OUR PROJECTS THIS YEAR AS RESULT.

BUT, BUT, UH, JUDGE LEWIS HAS BEEN SU SUCCESSFUL.

UH, MEDINA COUNTY HAS BEEN CONDITIONALLY, UM, FUNDING, UM, LIKE ACOG WAS LAST YEAR, UH, CONGRESSIONAL APPROPRI THAT WILL ALLOW HIM TO REPLACE ALL BIG WIN, BY THE WAY, ALL THE SUBSCRIBER EQUIPMENT, LAW ENFORCEMENT, ANYWAY IN THE COUNTY WITH MULTI-BAND RADIOS.

WELL, THAT'S A BIG GAME CHANGER BECAUSE THE REASON IS, IS THE MULTI-BAND RADIO IS THE LOW HANGING FRUIT.

YOU CAN'T DO ANYTHING OUTSIDE OF YOUR OWN LITTLE BUBBLE UNLESS YOU HAVE THAT RADIO.

BUT BY HIM GETTING, GETTING THOSE RADIOS NOW AT A COUNTY LEVEL, HE HAS AN ISSUE TO DECISION TO MAKE.

NOT TO PUT THIS IN MIND, BUT DO I, DO I UPGRADE WHAT I HAVE NOW OR DO I, SINCE I HAVE CAPABLE OPERATING, I HAVE THIS NICE BIG OLD FAT ACCOM SITE SITTING RIGHT IN, HON MAYBE, MAYBE NOT.

DEPLOY A COUPLE OF SEVEN MEGAHERTZ SITES IN MY COUNTY AND HOOK INTO AARON AND USE THAT AS MY ONGOING KIND OF PICTURE.

SO THAT'S WHERE THESE SITES KIND OF OF START THE CREATIVE USAGE FLOW, BUT THE KEY TO THAT MULTI RADIO

[00:30:02]

POSITION TO BE ABLE TO, YOU KNOW, ENTERTAIN THOSE IDEAS.

THE OTHER THING I HEARD YOU SAID, I JUST WANTED TO THANK JUDGE LUTZ FOR THE SWAT TEAM AND THE AIR UNITS THAT HE'S GONNA ACQUIRE FOR PILOT SARCASM.

I'M THE PILOT AND THE PILOT, YEAH, PILOT, I'M SORRY, YES MA'AM.

MAYOR DODGE, DONNA DODGE, AND MAYOR OF SEGE.

SO WHAT I HEAR YOU SAYING IS THAT ONCE THIS IS PUT IN PLACE, THEN PROCESSES AND PLANS AND COMMUNICATION EDUCATION TOOLS WILL BE PLACED SO THAT, UM, WE CAN BEGIN UTILIZING.

IS THAT WHAT I HEAR YOU SAYING? YES.

OKAY, THANK YOU.

THAT WAS, THERE'S SITE, BY THE WAY, THERE'S A SITE .

I KNOW YOU USE LCRI SYSTEM, BUT, UH, YOU'LL HAVE THIS, YOU'LL HAVE THIS AS A, AS AN OPTION AS WELL.

THANK YOU FOR MORE THAN 20 YEARS, OR 30, 25, MAYBE.

30.

30, 30.

PURDY.

THANK YOU.

I'VE WORKED WITH ROBERT ALMAN, ONE OF THE BEST IN THE BUSINESS.

HE KNOWS WHAT HE'S DOING, HE'S HIGHLY REGARDED, AND, UM, THERE IS BETTER PERSON TO RUN THIS ONE.

NOT THAT HE NEEDS TO HEAR THAT FROM ME BECAUSE HE HEARD IT BEFORE.

HE, HE EARLIER HE SAID, YOU HAVE A BLANK CHECK.

SO I, I, YOU KNOW, CLIFF HEARD TOO.

CLIFF, I'M WITH YOU.

.

ANYTHING ELSE? THANK YOU.

THANK YOU, THANK YOU.

OKAY, WE'LL GO ON TO ITEM NUMBER,

[7. Executive Director’s Monthly Report - Clifford Herberg A. Staffing Updates: B. Program Status and Operational Updates: Agency Contract Performance Report (CPR) Aging Services Alamo Regional Transit (ART) Public Affairs & Communications Intellectual & Developmental Disability Services Natural Resources Public Safety Regional Services Environmental Conservation Military & Veterans Affairs Weatherization Assistance Program C. Organizational and General Administration Updates: Building Update Administration Policy Review Chief Financial Officer General Counsel]

UH, SEVEN, WHICH IS THE EXECUTIVE DIRECTOR'S MONTHLY REPORT WHILE HE'S WALKING UP FROM PODIUM.

I WILL SEND THAT PDF OF THAT PRESENTATION, EVERYONE, IT'S, I'LL EMAIL THAT TO EVERYONE THIS AFTERNOON.

THANK YOU.

THANK YOU.

GOOD MORNING, EVERYONE.

UM, I DO WANT ADD, I THINK THE, UH, I KNOW I SENT OUT THAT LETTER ON THIS INTEROPERABILITY, BUT IT'S, YOU KNOW, ONE OF THE THINGS THAT WANT, WANNA ADD ABOUT, IT'S ONE OF THOSE THINGS WHERE WHEN YOU'RE MAKING THE DECISION TO SPEND THE MONEY, YOU SIT THERE AND THINK THOSE RECORDS ARE SO EXPENSIVE, EXPENSIVE, AND YOUR DEPARTMENTS ARE DOING FINE RIGHT NOW WITH A SINGLE VAN RADIO.

BUT IT'S ONE OF THOSE THINGS, THOSE THINGS WHERE IT'S NOT IMPORTANT UNTIL THE IS, YOU KNOW, AND THEN YOU REALLY NEED, YOU NEED 'EM, AND YOU'RE DESPERATE WITHOUT THEM.

SO, UM, I REALLY THANK ROBERT FOR COMING HIS PRESENTATION ON A VERY IMPORTANT SUBJECT TO YOUR CONSIDERATION.

UM, SO TO BEGIN MY REPORT THIS MONTH, I WANNA TALK ABOUT A COUPLE OF CHANGES OR, OR A UPGRADE IN OUR STAFF STAFFING.

UH, I KNOW ALL OF YOU HAVE HEARD ME TALK ABOUT TIME AND AGAIN ABOUT THIS, UH, UNPRECEDENTED, UNPRECEDENTED LEVEL OF OPPORTUNITY WITH OUR GRANT.

AND, UH, SO, SO PART OF THAT IS, UH, PART OF THAT EFFORT, EFFORT TO GET THESE GRANTS IS I HAVE BEEN GOING OUT TO THE VARIOUS COUNTIES AND WE'RE TRYING TO GET ONE COUNTY A MONTH AND TAKING A TOUR JUST TO SEE THE NEEDS OUT THERE.

AND BASICALLY WITH THE LEVEL OF GRANT OPPORTUNITY OPPORTUNITIES IN OUR REGION.

AND AS I'VE TOLD YOU BEFORE, OR WE REALLY WERE TASKED IN TRYING TO PUT OUT THE MAJOR GRANTS THAT WE SUBMITTED LAST MONTH.

AND SO, SO I'VE DECIDED HAVE TWO, TWO NEW POSITIONS TO OUR REGIONAL SERVICES IN THE DEVELOPMENT AREAS.

WE'LL BE ADDING ANOTHER GRANT WRITER AND A TECHNICIAN OR ASSISTANT TO SEEK OUT FUNDING, FUNDING OPPORTUNITIES, COORDINATE WITH OUR MEMBER GOVERNMENTS ON THOSE OPPORTUNITIES, AND APPLY, IMPLEMENT THE GRANTS ONCE RECEIVED.

UH, AND MY GOAL TO EXPAND AND ADD THAT STAFF AS NEEDED.

SO WE REALLY, UM, YOU KNOW, WE REALLY WANT YOUR WANT, YOUR INPUT ON WHAT YOUR NEEDS ARE, WHERE YOU THINK YOU CAN APPLY FOR SOMETHING TO ASSIST YOU.

AND WE WANT TO WORK WITH YOU TO IMPLEMENT THAT, THAT GRANT AND MAKE IT A SUCCESS.

AND AS I SAID, TAKE ADVANTAGE OF THESE FUNDING OPPORTUNITIES WHILE THEY'RE OUT THERE.

UH, AND OUR, AND OUR PROGRAM STATUS AND OPERATIONAL UPDATES AND OUR AGING DEPARTMENT ON SEPTEMBER 4TH, FOURTH OF THIS YEAR, OUR JEWISH FAMILY SERVICE, SAN ANTONIO HOST, HOSTED THE SILVER SOLUTION RESOURCES TO LIVING LIVING LONG AND AGING STRONG EVENT.

ACO HAS OFFERED A, A STAFF OFFERED IN, IN-PERSON INTAKE SERVICES FOR OVER 300 SENIORS AND THEIR FAMILIES PROVIDING RESOURCES FOR HEALTH, HOUSING, AND FINANCIAL PLANNING.

SO THAT WAS A HUGE SUCCESS, UH, WITH JEWISH FAMILY SERVICES.

UH, ALSO EVERY, EVERY YEAR ACOMS CAREGIVER SUPPORT PROGRAM PARTNERS WITH TEXAS GRANDPARENTS RAISING, RAISING GRANDCHILDREN, AND SAN ANTONIO THREATS TO PROVIDE ESSENTIAL BACK TO SCHOOL CLOTHING FOR CHILDREN BASED BY OLDER CAREGIVERS.

UH, THIS YEAR, 480 CHILDREN WERE SUPPLIED WITH TWO OUTFITS FOR THE START, START OF THE SCHOOL YEAR, AND OF COURSE, REDUCING THE FINANCIAL BURDEN ON THESE GRANDPARENTS WHO HAVE TAKEN UP THIS CHALLENGE.

UM, ALSO AGING SPONSORED STUFF THAT THEN DRIVE, WHICH OFFERS BACKPACKS AND SCHOOL SUPPLIES FOR CHILDREN RAISED BY GRANDPARENTS.

THIS YEAR, THE PERFECT EFFORT SERVED OVER 450 CHILDREN, WHICH WAS A 20% INCREASE

[00:35:01]

FROM LAST YEAR.

AND DONATIONS AND PARTNERSHIPS TO CONTINUE GROWING THIS EFFORT.

AND WELCOME, UH, AS WE ALSO PROVIDE CAREGIVERS WITH RE, WITH SUPPORT AND RESOURCES FOR, UH, EMOTIONAL AND LOGISTICAL SUPPORT IN IDD, UH, ON OCTOBER 3RD, OUR STAFF PROVIDE INITIAL TRAINING ID SERVICE IDD SERVICES ON DEESCALATION TO THE SAN ANTONIO COMMUNITY OUTREACH AND RESILIENCY EFFORT.

THE TEAM, WHICH IS CONSISTS OF LAW ENFORCEMENT, FIRE, EMERGENCY, AND PSYCHOLOGICAL PERSONNEL, WILL LEARN HOW TO EFFECTIVELY UTILIZE DEESCALATION TECHNIQUES TO DIFFUSE POTENTIAL CRISIS SITUATIONS INVOLVING PERSONS WITH AN IDD.

AND I WANT TO SAY THAT, UH, BECAUSE OF OUR D SITUATION, THE STATE BEING THE LOCAL AUTHORITY, UH, FOR THE REGION, REGION HERE AT A, WE'RE THE ONLY COMPANY IN THE STATE WITH THAT TASK TASK.

UH, WE COORDINATE WELL WITH THE ACADEMY TO REALLY BE A LEADER IN THESE DEESCALATION TECHNIQUES.

UH, AND THOSE OF YOU IN LAW ENFORCEMENT KNOW THE CHALLENGES OF BEING, BEING WITH SOMEBODY IDD IN THAT KIND OF SITUATION, SITUATION.

SO WE ARE A LEADER IN THAT.

I'M VERY PROUD OF THAT EFFORT.

UM, IN MILITARY VETERANS AFFAIRS, VICTOR MEINA, WHO IS A PURPLE HARBOR RECIPIENT AND LEADING LOCAL ADVOCATE FOR TRAUMATIC BRAIN INJURY ISSUES, WILL BE HONORED AS OGS ASSOCIATION OF DOMESTIC COMMUNITY'S LOCAL, LOCAL.

AFTER SUSTAINING A MODERATE BRAIN INJURY.

DURING HIS, HIS THIRD TOUR IN IRAQ IN 2009, HE IDENTIFIED GAPS IN CARE.

HE NOW COLLABORATES WITH MILITARY AND LEGISLATIVE LEADERS TO ADVOCATE FOR BETTER TBI TREAT TREATMENT AND SUPPORT FOR VETERANS IN NATURAL RESOURCES.

THE FIRST PROJECT IN UNIVERSAL CITY IS CLOSED.

THE EDGE AT RANDOLPH IS A MULTI-FAMILY COMMUNITY CONSISTING OF 20 UNITS OF BUILT TO RENT DUPLEX.

THE ASSESSMENT IS VALUED AT $898,000 UNDER A 30 YEAR TERM.

SO WE'RE VERY PROUD TO SEE PACE CONTINUE TO GROW, AND LYLE'S DONE A LOT OF EFFORT TO, TO, UH, PROMOTE, PROMOTE THAT PROGRAM.

UM, ALONG THAT LINE, ACOG AND LYLE HOSTED A PACE WORKSHOP FOR COMMUNITY PROPERTY OWNERS, LENDERS, AND LOCAL GOVERNMENTS.

ON OCTOBER 3RD, WE HAD ENCOURAGED YOU TO LEARN MORE ABOUT PACE AND HOW IT CAN BENEFIT YOU AND YOUR COMMUNITIES.

LIKEWISE, ON OCTOBER 10, LYLE WILL PRESENT REGULATORY UPDATES ABOUT OZONE IN PARTICULATE MATTER TO THE SAN ANTONIO MANUFACTURERS ASSOCIATION ENVIRONMENTAL SEMINAR.

AND LYLE CONTINUES TO BE BUSY.

UM, ALAMO AREA, PINE CITIES WILL HOST ELECTRIC VEHICLE LISTENING SESSION FOR EV FLEET OPERATORS ON OCTOBER THE 14TH.

THIS WILL WOULD AN OPEN FORUM TO HELP IDENTIFY TECHNOLOGY GAPS, NEEDS FOR TECHNICAL ASSISTANCE AND BEST PRACTICES FOR EV FLEETS.

AND FINALLY, ON OCTOBER 15TH, WHILE WILL PROVIDE A BASE PRESENTATION THAT THE CITY'S ECONOMIC DEVELOPMENT FORUM.

[00:40:01]

QUESTIONS.

UM, IN OUR WEATHERIZATION ASSISTANCE PROGRAM, ONCE, UM, SEPTEMBER THE THIRD THROUGH THE SIXTH, RECENTLY, THE WAKE OF THE WEATHERIZATION TRAINED 42 INDIVIDUALS, INCLUDING CONTRACTORS FOR THE EPA, A LED RENOVATOR CERTIFICATION.

THAT WAS A NICE, NICE TURNOUT FOR THAT TRAINING TRAINING.

AND WE ENCOURAGE AND INVITE OUR CONTRACTORS AND COMMUNITY PARTNERS TO JOIN IN OUR UPCOMING TRAINING SESSIONS TO OBTAIN, ENHANCE THEIR SKILLS.

AND WITH THAT, UH, THAT CONCLUDES I LOSE MY REPORT FOR THIS ONE.

VERY GOOD.

OKAY.

TAKES US TO THE CONSENT AGENDA.

IF YOU LOOK ON YOUR AGENDA ON ITEMS, UH, STARTING AT THE ITEM EIGHT ON THE AGENDA, UH, WE CAN ADOPT ALL OF THEM OR TAKE ANY ONES UP OF 'EM OUT OF THE CONSENT AGENDA IF YOU'D LIKE.

IS THERE A MOTION? SO MOVED.

SECOND HAND? ALL OF THEM.

ALL OF THEM.

OKAY.

EIGHT THROUGH 13? YES, ALL OF IT.

OKAY.

WE HAVE A MOTION AND A SECOND.

IS THERE ANY, UH, DISCUSSION? THOSE IN FAVOR SAY AYE.

AYE.

AYE.

OPPOSED? MOTION CARRIES.

MOVING TO NEW BUSINESS ITEM

[14. Consider and act upon the recommendation to create an employee benefits trust to obtain health related insurance. – Cliff Herberg]

14, CONSIDER AN ACT UPON THE RECOMMENDATIONS TO CREATE AN EMPLOYEE BENEFITS TRUST TO OBTAIN HEALTH RELATED INSURANCE.

HERBERG.

YES, MR. CHAIRMAN, CHAIRMAN AND MEMBERS OF THE BOARD, THIS IS AN INTERESTING ITEM THAT WAS BROUGHT, BROUGHT TO OUR ATTENTION BY OUR HEALTH BENEFITS CONSULTANT, WHERE, UM, AND, UM, WHAT IT INVOLVES IS THE CREATION OF A HEALTH BENEFITS TRUST FOR OUR EMPLOYEES IN ORDER TO RECEIVE, RECEIVE ESSENTIALLY A 2.7% DISCOUNT OR 2.7% TAX SAVINGS ON OUR PREMIUMS. IT'S A VERY CONVOLUTED, UM, STATUTORY SYSTEM.

THEY COULD HAVE DONE IT A LOT EASIER.

BUT BASICALLY THE TEXAS INSURANCE CODE PROVIDES THAT IF A MUNICIPALITY, A, UH, HEALTH HOSPITAL DISTRICT OR A COUNTY OR OTHER ELIGIBLE ENTITY, UH, CREATES A, A HEALTH BENEFITS TRUST, THAT IS PRIMARILY, OR I SHOULD SAY A SINGLE PURPOSE TRUST, THAT IS PRIMARILY FOR, FOR THE PURPOSE OF PROVIDING HEALTH AND BENEFITS TO ITS EMPLOYEES, THEN THE REVENUE USED FOR THE INSURANCE COMPANY RECEIVED FROM THAT TRUST ARE NOT TAXABLE.

SO THAT'S ONE AN EASY WAY OF, YOU'RE SAYING A TAX EXEMPT ENTITY TO PAY TAXES ON THE REVENUE.

UH, AND SO THE INSURANCE COMPANY, BECAUSE THEY DON'T HAVE TO PAY TAXES ON THE REVENUE, IS WILLING TO KICK BACK OR REDUCE THE PREMIUM THAT ACCOM PAYS BY THAT APPROXIMATE 2.7% SAVINGS.

AND SO THEY WILL REDUCE OUR PREMIUM BY 2.7%, WHICH WORKS OUT TO ABOUT $70,000 ON OUR $2.6 MILLION ANNUAL PREMIUM.

INTERESTINGLY, IN MY CONVERSATIONS EARLIER THIS MORNING WITH JUDGE, JUDGE KELLY, UH, HE WAS MENTIONING HE HADN'T HEARD OF SUCH A THING, AND WE HADN'T HEARD OF IT, ASKED, UH, UNTIL OUR COUNCIL COUNSELOR HAD HEALTH BENEFITS COUNSELOR BROUGHT IT UP AND I REACHED OUT AND WAS TALKING TO ONE OF MY COLLEAGUES AT THE EAST TEXAS COLLEGE, AND THEY'RE IN THE PROCESS OF DOING THE SAME THING.

AND SO, UH, ESSENTIALLY THIS IS A CONTINUING BENEFIT TO THE AGENCY IN THAT WE ONLY, WE ALL KNOW THAT PREMIUMS ARE ONLY GOING TO CONTINUE TO GO UP.

SO THIS WILL BE A, AN ANNUAL SAVINGS OF ROUGHLY 2.7% OFF OF THE PREMIUM GOING FORWARD EACH AND EVERY YEAR.

UH, NOW IT DOES REQUIRE THE CREATION OF THE TRUST.

ALL OF YOU WOULD BE THE TRUSTEES, TRUSTEES.

AND SO I THOUGHT YOU MIGHT, MIGHT, SINCE YOU, SINCE I'M ASKING YOU TO SIGN A TRUST DOCUMENT, YOU MIGHT WANT TO KNOW A LITTLE BIT ABOUT WHAT YOUR OBLIGATIONS WOULD BE UNDER THE TRUST.

AND SO, UH, THE, THE SIGNIFICANT, SIGNIFICANT DETAILS OF THE TRUST IS THAT EACH MEMBER OF THE BOARD OF DIRECTORS IS A TRUSTEE.

UH, A BOARD MEMBER REMAINS A TRUSTEE DURING THEIR TERM AS A BOARD MEMBER OF THE BOARD.

AND THEIR DUTIES TERMINATE WHEN THEY LEAVE THE BOARD OF DIRECTORS.

SO IT'S ONLY A, YOU'RE ONLY INVOLVED WHILE YOU'RE EXHIBIT THERE, SIT ON THE ACON BOARD.

UM, AND THO THE ROLE, ROLE AND DUTIES OF TRUSTEE AUTOMATICALLY PASS AFTER TO THE SUCCESSORS ON THE BOARD OF TRUSTEE.

SO YOUR REPLACEMENT WOULD THEN YOUR DUTIES AS TRUSTEE, UH, BOARD MEMBERS.

THIS IS THE KEY POINT YOU MIGHT WANT TO KNOW.

BOARD MEMBERS SERVING AS TRUSTEES HAVE NO LIABILITY TO THE TRUST OR ANY GOOD FAITH ACTION ACTIONS TAKEN TO ADMINISTER THE TRUST.

SO AS LONG AS YOU DON'T TRY TO RAID THE $2.6 MILLION IN GOOD SHAPE.

UM, THE OTHER PART IS, UH, THE TRUSTEE.

AND THIS IS WHAT MAKES IT EASY FOR YOU.

THE TRUST ALSO PROVIDES THAT THE TRUSTEES MAY DELEGATE TO THE ACO EXECUTIVE DIRECTOR OF THE POWER TAKE SUCH ACTION AND EXECUTE THE NECESSARY DOCUMENTS TO CARRY OUT THE TRUST, TRUST INTENDED PURPOSES.

SO ALL INTENTS AND PURPOSES, UH, ONCE THE TRUST IS CREATED A COG AND THE STAFF WILL MANAGE, MANAGE THE TYPICAL, UH, ANNUAL,

[00:45:01]

UH, PURCHASE OF THE INSURANCE AND EXECUTE THE NECESSARY, NECESSARY DOCUMENTS TO CARRY OUT THOSE PURPOSES.

YOU'VE ALREADY DELEGATED THE AUTHORITY WHEN YOU, WHEN YOU, UH, VOTED TO APPROVE FIRE AS OUR BENEFITS CONSULTANT.

AND SO THEY TECHNICALLY ARE THE ONES THAT ENTERED THE CONTRACTS FOR US.

AND SO THAT'S THE WAY THE, THAT'S THE WAY IT WOULD REMAIN.

THE ONLY REAL DIFFERENCE IS, UH, THE FUNDS THAT WE, THAT WE DELEGATE, WE DESIGNATE FOR HEALTH BENEFITS, PREMIUM INSURANCE PREMIUMS WOULD BE PLACED IN TRUST.

THE TRUST WOULD BE PAY THE PREMIUM.

AND WITH THAT WE GET THE, THE REDUCTION IN THE PREMIUM OF THE 2.77%.

SO, UH, IT'S A LITTLE MORE CONVOLUTED THAN SIMPLY SAYING TAX EXEMPT, BUT THAT'S THE WAY THE STATE STRUCTURED IT.

SO WE'VE GOT TO CREATE, CREATE THE TRUST IF WE WANT TO TAKE THE BENEFITS.

UM, AND WITH THAT, THAT'S MY, THAT'S MY PRESENTATION.

IF YOU HAVE ANY QUESTIONS, BE ALLOWED TO ANSWER 'EM TO YOU.

I DO THINK IT'S SOMETHING THAT IF YOUR COUNTIES DON'T HAVE 'EM, YOU SHOULD LOOK AT 'EM AND BECAUSE IT WOULD SAVE YOU, OF COURSE, SIGNIFICANTLY MORE.

THE SIZE OF YOUR BUDGET ARE LARGER COUNTIES.

OH, OVER HERE FIRST I SAW IT.

DO WE, IS THE 2.7, IS THAT FOREVER OR ONE YEAR AND THE NEXT YEAR COULD BE DIFFERENT OR I, THAT'S A GREAT QUESTION.

THAT'S A GREAT QUESTION.

I AM PRESUMING IT'S 2.7 THIS YEAR.

THIS YEAR.

AND I AM PRESUMING OF COURSE, THAT IT DEPENDS ON WHAT THE LEGISLATURE SETS THE TAX RATES ON, ON INSURANCE COMPANIES PAYING THESE THINGS.

BUT, UH, THAT IS WHAT I RECEIVED FROM OUR, OUR BENEFITS COUNSELORS.

THAT'S WHAT IT HAS BEEN IN THE PAST.

I SUPPOSE IT'S ALWAYS SUBJECT TO CHANGE THE STATE LEGISLATURE OR WHO SETS WHO SETS THE RATE.

IT'S A STATE TAX, STATE TAX.

THE STATE, STATE TAX.

IT'S STATE, IT'S A STATE TAX.

THANKS.

OKAY.

UH, FIRST THE, IT APPLIES TO ALL GOVERNMENTAL.

SO COUNTIES, CITIES, THE STATUTES VERY ODDLY.

AWARD AWARD.

IT SAYS SPECIFICALLY COUNTIES, MUNICIPALITIES, AND HOSPITAL DISTRICT.

AND THEN THERE'S ANOTHER SECTION THAT ESCAPES ME THAT DOESN'T APPLY.

AND THE LAST THING SAYS ANY PREMIUMS OR REVENUES EXEMPT BY BY OTHER STATUTE.

SO YOU DON'T FALL OBVIOUSLY INTO COUNTY MUNICIPALITY OR HOSPITAL DISTRICT.

BUT BECAUSE WE ARE A POLITICAL SUBDIVISION OF THE STATE THAT IS TAX EXEMPT, THE PREMIUMS OR REVENUES THEY RECEIVE FROM US ARE EXEMPT BY OTHER STATUTE.

IS THIS, IS THERE ANY MATERIALS YOU CAN SH SHARE WITH INDIVIDUAL CITIES, COUNTIES WHO MAY BE INTERESTED IN LOOKING INTO THIS FOR THEIR OWN? OH, I'VE ALREADY ASKED THEM TO TAKE THE SHOW, THE SHOW ON THE ROAD.

OH, DID YOU? OKAY.

BECAUSE I MEAN, IF THAT'S, IF THIS IS THAT BIG OF A SAVINGS THAT COULD HELP THE LITTLE COUNTIES THAT I WILL BE GLAD TO, UH, SHARE WHAT I RECEIVED.

THERE'S LITTLE AND AND PER COX, BUT THE STATUTE IS, I MEAN THERE'S AN ATTORNEY GENERAL'S OPINION OUT THERE THAT TALKS ABOUT THE LEGISLATOR'S, LEGISLATURE'S ATTEMPT OR INTENT TO EXEMPT TAX PAYING THE TAX.

AND SO, UM, IT DISCUSSED THE TRUST A LITTLE BIT.

AND THEN I HAVE A SAMPLE TRUST DOCUMENT, WHICH IS REALLY, I MEAN, IT'S IN YOUR FILE, BUT IT'S REALLY BASIC TRUST DOCUMENT.

AND UM, THAT'S REALLY ALL WE HAVE IN THE STATUTE.

THAT'S IT THAT I CAN PROVIDE, I CAN ASK OUR BENEFITS COUNSELOR TO GET YOU ANYTHING THAT HE HAS.

BUT, UH, I CAN ALSO PROVIDE YOU THE NAMES OF LAW FIRMS THAT DO THIS KIND OF WORK.

YEAH.

IF YOU WOULDN'T MIND, I DON'T KNOW IF THAT COULD APPLY TO SEND IT OUT TO EVERYBODY JUST 'CAUSE THIS IS DEFINITELY, I'VE ALREADY ASKED YOU SOME INTEREST.

I'VE ALREADY ASKED HIM TO DO IT.

OKAY.

YEAH.

AND THEN NUMBER TWO, UH, THIS IS ABOUT, SO YOU SAID IT'LL SAVE US OR SAVE ANY ENTITY DOING IT PARTICULARLY HERE, 70,000 A YEAR.

IT DEPENDS ON WHICH WE HAD 2.7.

OUR, OUR PREMIUM, WHICH IS APPROXIMATELY, IT'S APPROXIMATELY $2.6 MILLION FOR THIS UPCOMING.

SO THAT'S WHERE I GOT THE 70002.7 ABOVE 2.6 MILLION.

WHAT IS THE ANNUAL EXPENSE TO DO THIS? SO IS IT, THAT'S, YOU'LL SAY 2.7, IS THERE ANY COST OR IS IT BASICALLY THAT'S, I MEAN, WE'RE GONNA, OF COURSE WE'RE GONNA DO EVERYTHING IN HOUSE.

UM, MY COLLEAGUE UP IN, UM, UP IN UH, EAST TEXAS IS PAYING, PAYING A CONSIDERABLE AMOUNT OF MONEY TO SOME LEGAL FIRMS TO PROTECT, TO PREPARE ALL OF THIS.

FORTUNATELY WITH SPIRE, THEY WERE ABLE TO PROVIDE ME THE DOCUMENTS IN THERE, THE RE RESOLUTION THAT YOU HAVE, BY THE WAY, YOU HAD TO HAVE TO EXECUTE A PROOF, A RESOLUTION THAT'S BEFORE YOU TODAY, UH, TO UH, CREATE THE TRUST.

AND SO HE WAS ABLE TO PROVIDE ALL OF THOSE DOCUMENTS.

AND I DID MY OWN RESEARCH AND, AND UM, AND UH, THAT'S HOW I DID IT.

SO NO, NO EXPENSE TO STOCK, BUT OF COURSE, IF YOU WANT TO HAVE ONE OF THESE FIRMS, IT MAY, IT MAY BE SOME EXPENSE.

OKAY.

THANK YOU.

GREAT IDEA.

CERTAINLY.

YES SIR.

THE SAVINGS WOULD STAY WITH THE TRUST OR WOULD GO TO THE GENERAL FUND.

[00:50:01]

IT WOULD STAY WITH THE TRUST.

WITH THE TRUST.

IT WOULD STAY IN THE TRUST TO REDUCE THE PREMIUM.

SO REALLY WHAT WE, I MEAN, I MEAN THAT'S REALLY WHAT IT IS, RIGHT? THEY'RE GONNA BILL US 2.7% LESS THAN THE $2.66 MILLION THEY QUOTED US.

AND THIS WOULD TAKE EFFECT.

SO WE'LL TRANSFER THE MONEY FROM ACOM INTO THE TRUST AND THEN PAY THE PREMIUM AS IT BECOMES DUE, UH, FROM THE TRUST.

SO IT'LL TAKE A MOTION TO DO THE TRANSFER.

I SHOULD, NO, BECAUSE, UH, IF YOU AUTHORIZE US THAT YOU'RE AUTHORIZING TO TAKE THOSE ACTIONS UNDER THE TRUST DOCUMENT AND IT'LL TAKE IT BACK.

WE AS SOON AS WE APPROVE IT.

BUT HOPEFULLY IF, IF THE BOARD DECIDES TO APPROVE IT, THEY'LL USE IT.

THIS COMING HERE WHEN WE DO ALL BLUE CROSS BLUE SHIELD GETTING FOR ANOTHER YEAR'S TERM OF INSURANCE, JUDGE EVANS, FOR THOSE OF US THAT BELONG TO TAC TO THE RISK MANAGEMENT POOL, I'M SORRY, I'M SORRY.

WE, THE RISK MANAGEMENT POOL WITH TACT THAT WE BELONG, THAT WE BELONG TO IN OUR COUNTY.

MM-HMM.

, WOULD THIS QUALIFY FOR THAT? I DON'T KNOW THE ANSWER TO THAT QUESTION.

I DUNNO.

I DON'T THINK SO.

WE NEED TO FIND OUT, COME UP.

WE DON'T 'CAUSE WE DON'T GO THIS POOL.

WE HAVE ONE DONNA DODGE MAYOR.

WE'VE HAD AN EMPLOYEE TRUST, BENEFIT TRUST FOR YEARS.

WELL, AS LONG AS I WAS ON COUNCIL AND MAYOR, SORRY.

I DUNNO.

I STOP.

UM, AND SO WE HAVE A MEETING EVERY YEAR AND THE AMOUNT CHANGES DEPENDING ON THE TAX AND THAT SORT OF THING, AND IT WORKS REALLY BEAUTIFULLY AND REALLY WELL.

UM, BUT WE DON'T BELONG TO A RISK POOL EITHER.

UM, TO ANSWER YOUR QUESTION, SO I HAVE LIMITED KNOWLEDGE, BUT THAT'S WHAT I KNOW.

WE JUST NEED TO FIND OUT IF IT QUALIFIES POOL.

LEMME ASK OUR, I'M KIND OF PIGGYBACK ON MY COLLEAGUE IN EAST TEXAS 'CAUSE HE'S HIRING ALL THE HIGH POWERED LAWYERS AND THIS, SO I'M, I'LL ASK HIM A QUESTION, SEE IF I CAN GET THE BENEFIT OF ALL HIS LEGAL.

I THANK YOU MR. CHAIR.

I GUESS THAT IS AN ADVANTAGE IS HAVING OUR EXECUTIVE DIRECTOR AS A ATTORNEY.

SO THANK YOU.

LISA, I WANTED TO ASK YOU, IS THIS SOMETHING YOU HEARD OR OR DO WITH CPS ENERGY? CPS ENERGY DOES HAVE A HEALTH BENEFITS TRUST.

UM, AND I, YOU DIDN'T SAY IT, BUT I'M ASSUMING YOUR, YOUR BENEFITS CONSULTANT, THIS IS JUST ONE OF THEIR RECOMMENDATIONS OF OTHER THINGS YOU CAN DO FOR NEGOTIATING PREMIUMS. REDUCING, UH, I WILL, I WILL OFFER THAT ABOUT SEVEN YEARS AGO WE GOT OUR OWN, UM, CONSULTANT TO REVIEW ALL OF OUR BENEFITS.

THEY NOW NEGOTIATE ALL OUR, OUR, WE'RE SELF-INSURED.

THEY NEGOTIATE OUR RATES.

THEY HELP US KEEP UP WITH PHARMACY.

HEALTHCARE HAS GOTTEN SO COMPLICATED.

WE PAY ABOUT A HUNDRED THOUSAND DOLLARS A YEAR FOR AN ORGANIZATION TO REVIEW OUR PLANS AND HELP US MANAGE THEM, WHICH ARE MILLIONS OF DOLLARS.

THAT HAS BEEN ONE OF THE BEST INVESTMENTS WE HAVE EVER MADE.

IT'S SUPER HELPFUL AND YES, WE ALREADY HAVE A TRUST.

THANK YOU SO MUCH.

THANK YOU.

THANK YOU MR. CHAIR.

AND I THINK TO BUILD ON THAT A LITTLE BIT AND THAT WE ARE TRYING TO DO ALL, ALL THE THINGS THAT YOU MENTIONED, INSPIRE HAS DONE A GREAT JOB.

YEAH.

I WILL TELL YOU THAT I, IF I RECALL AND DEIDRE CORRECT, THANK BLUE CROSS AND BLUE BLUE CROSS AND BLUE SHIELD CAME BACK, 19% PROPOSED INCREASE THIS YEAR.

AND THEY SAID, AND THEY GOT IT TOO.

NEGOTIATIONS .

YES.

YES.

AND THEN AFTER NEGOTIATIONS AND FIRE DID ALL OF THIS, DID A GREAT JOB.

UH, WE'RE LOOKING AT CLOSE TO 5%.

THERE YOU GO.

YEAH.

AND SO 5% AND HOPEFULLY WITH THIS 2.7% REDUCTION, UM, THAT WILL HELP SIGNIFICANTLY IN, IN THE, UH, INCREASE COST FOR THIS YEAR.

MAYBE ONE OF THE THINGS WE COULD, WE COULD CONSIDER DOING IS INVITING SPIRE TO COME MAKE A PRESENTATION TO US AND, UH, ANSWER SOME OF THESE QUESTIONS FOR THOSE OF US THAT, THAT ARE LOOKING AT THE POSSIBILITY OF A TRUST TO SEE WHETHER OR NOT WE QUALIFY.

I WILL TELL YOU THE, UH, HIS NAME IS DENNIS WIRE.

S AS I SAID, HE'S DONE A GREAT JOB FOR US.

HE WAS WITH, HE'S, HE'S WITH FIRE NOW, HE'S WITH WAS WITH, WITH GALLAGHER BENEFITS CONSULTING BEFORE.

AND THAT'S WHERE WE FIRST MET DENNIS.

THE FIRST THING OUT OF HIS, OUT OUTTA HIS MOUTH, HE SAID TO ME, I DON'T, HE'LL SAVE YOU TIME AND TIME AGAIN IS I'M NOT A LAWYER, I'M JUST GIVING, I'M JUST GIVING YOU THE DOCUMENTS.

SO I DON'T KNOW HOW MUCH HE'LL HELP, BUT I'LL BE GLAD TO ASK DENNIS IF HE WOULD GIVE YOU A PRESENTATION OR MAYBE HE COULD SUGGEST SOMETHING.

WELL, ONE OF THE THINGS THAT I FOUND OUT IN FROM WHEN CLIFF WAS BRIEFING ME ON THIS WAS WHEN WE WERE WITH GALLAGHER, THEY WERE LOOKING INTO PUTTING US INTO A TRUST.

WHEN WE MOVED OVER TO SPIRE, IT GOT, IT FELL BETWEEN THE CRACKS.

NO, IT FELL, FELL BETWEEN THE CRACKS.

THE CRACKS.

WE WERE, WE WERE LOOKING AT DOING THIS FIVE YEARS AGO.

YES, YES.

THE DENNIS WAS, DENNIS AND HIS TEAM WERE WITH GALLAGHER AND WE HAD A GREAT RELATIONSHIP, RELATIONSHIP.

AND UM, THEN EAST WENT OFF AND WENT, HIS TEAM WENT TO THE FIRE.

AND UM, OUR CONTRACT REMAINED WITH GALLAGHER.

WHEN THAT CONTRACT TERMINATED, WE RENEWED THIS FIRE.

AND SO, SO IN THIS PROCESS, THIS PROCESS, NOW THAT WE HAVE

[00:55:01]

SPIRE, DENNIS COMES IN AND SAYS, OH, YOUR TRUST IS GONNA SAVE YOU THAT, I DON'T FORGET THAT.

AND WE SAID, WHAT TRUST? HE SAID, OH, DIDN'T I SET THAT UP FOR YOU WHEN I WAS IN GALLAGHER? AND I SAID, NO, NO DENNIS, WE DON'T HAVE A TRUST.

AND HE SAID, OH, WELL I MEANT TO DO THAT.

AND THEN WE LEFT.

SO WE'VE LOST THE BENEFIT FOR A FEW YEARS, BUT HOPEFULLY WE'LL CATCH UP NOW.

BUT THE, THE BEAUTY OF THE WHOLE THING IS WE PAY THE, WE PAY THE MONEY, UH, NOTHING REALLY CHANGES EXCEPT WE GO THROUGH A COUPLE OF EXTRA STEPS IN, IN MAKING THE PAYMENTS.

EXACTLY.

UH, WE END UP AT THE SAME PLACE WHERE WE ARE TODAY, BUT WE SAVE THE 2.7% AND YOU CAN ALL CLAIM TO BE TRUSTEES ON A BIG TRUST , BUT WE CAN DELEGATE THOSE RESPONSIBILITIES TO YOU.

YES.

THAT WAY YOU DON'T HAVE TO MESS WITH IT.

AND IF THIS IS APPROVED, THE COURT CHOOSES TO APPROVE IT AS THERE'S A RESOLUTION AUTHORIZED IN THE CREATION OF THE TRUST.

AND IF YOU WOULD, UM, I HAVE SIGNATURE BLOCKS FOR YOU WHERE YOU CAN SIGN OFF AS YOUR ITEM NAME AND UM, AS TRUSTEE AND THEN SUSIE WILL NOTARIZE THOSE AND THAT BECOMES PART OF THE DOCUMENT.

SO IF YOU WOULD, UH, IF YOU DO APPROVE THIS, UH, PLEASE STOP BY BEFORE YOU PLEAD LEAVE TODAY IN HERE.

I'VE MOVED.

DO YOU HAVE THEM? I HAVE THEM AND I'M GONNA PASS THEM OUT.

OKAY.

I'M SORRY JUDGE EVANS, I MOVED TO APPROVE SECOND.

WHO WAS THE SECOND? SECOND.

OKAY.

UH, MAYOR SCHROEDER WAS THE SECOND.

WE HAVE A MOTION AND A SECOND TO APPROVE THE EMPLOYEE BENEFITS TRUST AS PROPOSED AS PRESENTED HERE TODAY.

UH, ANY DISCUSSION CHAIR? I HAVE, I DO HAVE ONE QUESTION.

YES, SIR.

UM, SO ON, ON THE BENEFICIARIES OF THE TRUST, IT STATES THE ACOG OFFICERS, AM I SAFE TO ASSUME THAT YOU'RE INCLUDED AS A BENEFICIARY OF THE TRUST? Y YES, TO THE EXTENT TO THE, I'M AN EMPLOYEE.

I PUT OFFICERS IN THERE.

UM, JUST, JUST BECAUSE THAT'S THE WAY THE TRUST DOCUMENT WAS STRUCTURED AND I DIDN'T WANT TO HAVE I PUT 'EM IN AS A BELT SUSPENDERS APPROACH.

APPROACH.

'CAUSE IT DOES SAY OFFICERS AND EMPLOYEES.

SO, SO MY, MY QUESTION REALLY GOES TO POTENTIAL CONFLICT.

IF YOU'RE A BENEFICIARY OF THE TRUST AND THE TRUSTEES ARE DELEGATING TO YOU TO SIGN PAPERWORK ON BEHALF OF THE TRUST OR ON BEHALF OF THE TRUSTEES.

I MEAN, I, I DUNNO IF YOU'VE THOUGHT ABOUT THAT OR IF THERE'S ANY CONCERN FOR A CONFLICT THERE AT SOME POINT IT COULD ARISE.

WELL, IF THERE WERE A CONFLICT, I'D WANT HIM TO REFER IT BACK TO THE ENTIRE BOARD.

I'M I'M JUST SAYING IF THE BOARD TAKES SOME ACTION THAT MAYBE WOULD NOT, THAT WOULD BE THE TRUSTEES WOULD DETERMINE IT WAS APPROPRIATE, BUT THE BENEFICIARIES MAY NOT THINK IT WAS IN THEIR BEST INTEREST.

I MEAN, OR I THINK HE'S SAYING THERE'S AN APPARENT CONFLICT JUST IN THE NATURE OF THE WAY IT'S SET UP RIGHT NOW.

CORRECT.

RIGHT.

THE BENEFICIARY.

YOU'VE GOT ONE OF THE BENEFICIARIES THAT HAS SOME SIGNATORY AUTHORITY.

I MEAN OBVIOUSLY IT'D BE DELEGATED TO THEM LIMITED BY WHATEVER ACTION THE BOARD TAKES.

BUT I JUST, IT'S JUST SOMETHING I JUST THOUGHT OF.

I DIDN'T, I DIDN'T KNOW IF IT'D BEEN, I DUNNO IF THERE'S ANY CONCERN THERE.

I'M NOT, I'M NOT FAMILIAR WITH TRUST ENOUGH TO KNOW IF THAT'S AN ISSUE OR NOT.

I SUPPOSE IF THERE WAS ANY, ANYTHING SPECIAL TO ME.

I SEE WHAT YOU'RE SAYING.

THAT'S A GOOD POINT.

BUT A TRUSTEE, A BENEFICIARY CAN, CAN BE AS LONG AS WHAT IS THE SPLIT OF THE ESTATE AS I RECALL, A TRUSTEE AND A BENEFICIARY CAN, MY POINT IS A BENE BENEFICIARY CAN BE A TRUSTEE OF THE ESTATE.

UH, YOU SEE THAT A LOT OF, OF, UM, ESTATE PLANNING DOCUMENTS.

SO, UM, I GUESS TO THE EXTENT THERE'S A CONFLICT, IF THERE WAS ANYTHING THAT AFFECTED ME SEPARATELY OR SPECIAL, I OUGHT TO COME BACK TO BACK TO THE BOARD.

BUT THIS WOULD BE JUST THE STANDARD INSURANCE THAT EVERYBODY GETS IS WHAT I GET.

WELL, REGARDLESS OF WHAT ACTION, WE MAY, SAME QUESTION.

REGARDLESS OF THE ACTION WE MAY OR MAY NOT TAKE TODAY.

WHY DON'T YOU LOOK INTO THAT AND GET US AN ANSWER AND BRING IT BACK AT THE NEXT BOARD MEETING.

ALRIGHT, THAT SOUNDS LIKE A GOOD IDEA.

WE HAVE A PROBLEM WITH IT.

WE CAN ADDRESS IT THEN.

THAT'S A GOOD QUESTION.

ANY OTHER DISCUSSION? THOSE IN FAVOR SAY AYE.

AYE.

OPPOSED? MOTION CARRIES.

AND I HOPE THEY WORK FOR ALL THE COUNTIES AND UNI MUNICIPALITIES IN.

YES.

YES.

DO YOU STILL WANT US TO SIGN UNTIL THAT QUESTION ANSWERED OR DO YOU WANT US TO WAIT UNTIL NEXT MEETING TO SIGN? LET'S GO AHEAD AND SIGN.

IF WE'VE GOT A PROBLEM WITH THE CONFLICT OF, TO FIGURE OUT HOW TO DEAL WITH THAT, WE STILL WORK.

WHO WAS REFERRING TO? THERE ARE TWO SIGNATURES PER POUND.

JUST PASS THESE DOWN AND THEN LIKE I SAID, I'LL VOTER EVERY BECAUSE I KNOW EVERYBODY.

RISK MANAGEMENT.

ONE.

CALL TO ATTACK HIM.

ANSWER

ITEM

[19. Consider and act upon the recommendation to authorize the Executive Director to enter into an agreement with Bexar County for an Adult Detention Center Liaison pilot program in the approximate amount of $200,000. This item does not require a budget amendment. - Virginia Charles]

19, CONSIDER AN ACT UPON THE RECOMMENDATION TO AUTHORIZE THE EXECUTIVE DIRECTOR ENTER INTO AN AGREEMENT WITH BEAR COUNTY FOR AN ADULT DETENTION CENTER LIAISON PILOT PROGRAM IN THE APPROXIMATE AMOUNT OF $200,000.

THIS ITEM DOES NOT REQUIRE BUDGET AMENDMENT AND THIS PILOT LIE OF Y'ALL WILL REMEMBER, WE'VE BEEN ENGAGED WITH BEAR COUNTY COUNTY FOR THE PAST TWO YEARS, UH, DOING THIS.

THIS WOULD WOULD BE, I BELIEVE THE THIRD YEAR OF THAT PILOT PROGRAM WHERE WE'RE ACTUALLY ABLE TO PUT ONE OF OUR CASE MANAGERS ON SITE AT THE ADULT DETENTION CENTER, ALONG WITH HAVING A PSYCHOLOGIST THAT GOES ON SITE WHEN NECESSARY TO CONDUCT ELIGIBILITY DETERMINATIONS WHILE FOLKS ARE DETAINED THAT MIGHT POTENTIALLY BENEFIT FROM, UH, INTELLECTUAL DEVELOPMENTAL DISABILITIES SERVICES.

UM, SO BEAR COUNTY HAS BEEN VERY PLEASED WITH THAT PARTNERSHIP AND HAS, UH, SEEN THE BENEFIT OF US BEING ABLE TO HELP TRANSITION FOLKS OUT OF JAIL, UH, THAT HAVE NOT, NOT NEEDED TO, HAVE NOT NEEDED THAT LEVEL OF SUPPORT.

UM, SO WE'RE HAPPY TO CONTINUE TO PARTNER WITH BEAR COUNTY COUNTY ON THIS PROJECT.

ANY QUESTIONS? I'LL TELL YOU, THOSE OF US IN THE HINTERLANDS ARE VERY ENVIOUS THAT YOU HAVE MISS .

I SHERIFF IF I COULD.

YEP, PLEASE.

UM, SO YOU SAID THE BEXAR COUNTY SHERIFF'S OFFICE FULLY SUPPORTS THIS? ABSOLUTELY.

OKAY.

GOD BLESS.

I I GUESS I WOULD JUST WANT TO BE THOUGHTFUL ABOUT THE DIFFERENT LAYERS THAT WE KIND OF HAVE WITHIN, UM, WITHIN THE, THE DETENTION PROCESS AND, UH, THE DISPATCH PROCESS AND STUFF TO POTENTIALLY, UM, IDENTIFY THESE SITUATIONS AND EVERYTHING.

THIS COULD BE, I GUESS, ANOTHER LAYER, UH, ULTIMATELY IN THAT.

BUT, UM, IF, IF, IF THEY'RE PARTNERING AND THEY'RE SUPPORTIVE, THEN, THEN I'M SUPPORTIVE.

I JUST WANT TO BE THOUGHTFUL ABOUT THE OTHER LAYERS IN THAT PROCESS.

ABSOLUTELY.

SO WE, WE WORK CLOSELY WITH, UM, COUNTY STAFF AND THE, THE CENTER FOR HEALTHCARE SERVICE CONTRACTORS THAT ALREADY WORK AT, AT THE, THE GEOLOCATION.

UM, AND SO OUR, OUR LIAISON IS ACTUALLY HOUSED ON THE DETENTION CENTER SIDE.

UM, THE SHERIFF'S OFFICE HAS, HAS MADE SPACE AND AN OFFICE AVAILABLE, UH, TO WORK WITH OUR TEAM.

THEY'VE, THE SHERIFF'S OFFICE OFFICE HAS BEEN VERY SUPPORTIVE.

UM, AND WE REALLY WORK, UH, TO INTEGRATE TO THOSE EXISTING PROCESSES AND NOT CREATE SOMETHING I THINK THAT'S SEPARATE OR REDUNDANT.

OKAY.

THANK YOU.

IN FACT, HAVING ONE OF OUR IDD PEOPLE THERE IS ACTUALLY BEING SENSITIVE TO THOSE LAYERS, UH, THAT, THAT WOULD OTHERWISE BE MORE INSENSITIVE.

OKAY.

THAT'S WHY, WHY WE'RE ENVIOUS OF IT.

WE'D LIKE TO HAVE.

THANK YOU.

YES, SIR.

ANY OTHER COMMENTS OR DISCUSSION? MOTION TO APPROVE THIS ITEM? UH, OKAY.

SECOND 19.

THAT WAS SECONDED BY MAYOR UH, DENNIS.

MAYOR DENNIS.

MAYOR RILEY.

THANK YOU.

ANY OTHER DISCUSSION? THOSE IN FAVOR SAY AYE.

A OPPOSED? MOTION CARRIES.

MOVING ON TO,

[20. Consider an act upon the recommendation to authorize the Executive Director to extend the contract for financial management services with contractor, Consumer Directed Services (CDS) of Texas, for services related to the Veterans Directed Care program from October 1, 2024, to September 30, 2025. This item does not require a budget amendment. - Juliet Gudgel]

UH, ITEM AND ITEM 20.

CONSIDER AND ACT UPON THE RECOMMENDATION TO AUTHORIZE THE EXECUTIVE DIRECTOR TO EXTEND THE CONTRACT FOR FINANCIAL MANAGEMENT SERVICES WITH CONTRACTOR CONSUMER DIRECTED SERVICES OF TEXAS FOR SERVICES RELATED TO VETERAN DIRECTED CARE PROGRAM FROM OCTOBER 1ST, 2024 TO SEPTEMBER 30TH, 2025.

THIS ITEM DOES NOT REQUIRE A BUDGET AMENDMENT.

GOOD MORNING SCHEDULE.

CHAIRMAN KELLY, MEMBERS OF THE BOARD.

MY NAME JULIE.

I'M YOUR VETERAN'S PROGRAMS MANAGER.

AND TODAY OUR ASK IS A CURRENT CONTRACT WITH VETERANS DIRECTED CARE, UH, WITH CD SS TEXAS TO SUPPORT OUR VETERANS DIRECTED CARE.

CARE.

THE BDC PROGRAM IS FUNDED, FUNDED BY THE VA AND PROVIDES HOME CARE CARE SERVICES TO, TO ELIGIBLE VETERANS.

THE CURRENT CONTRACT CS TEXAS IS SET TO EXPIRE AT THE END OF THE MONTH, AND IT'S ESSENTIAL THAT WE EXTEND THE CONTRACT TO ENSURE UNINTERRUPTED FINANCIAL MANAGEMENT SERVICES.

WE RECOMMEND THE BOARD OF DIRECTOR BOARD DIRECTORS AUTHORIZE THE EXECUTIVE DIRECTOR TO EXTEND THE CURRENT CONTRACT WITH CVS.

I'D BE HAPPY TO ANSWER, ANSWER ANY QUESTIONS THAT YOU HAVE, SEE WHAT'S THE AMOUNT, WHAT'S THE AMOUNT? UM, IT, IT AVERAGES ABOUT 22 MILLION BASED ON THE NUMBER OF, OF VETERANS AND EMPLOYEES THEY HAVE IN THE SYSTEM.

SO, WHAT WAS IT? YEAH, THERE'S NO AMOUNT.

I WAS JUST CURIOUS, BUT CORRECT.

[01:10:01]

THEY CHARGE US, WHAT IS IT? A HUNDRED ROUGHLY $110 A MONTH PER $15 PER PER PER 15 PER VETERAN.

AND WE HAVE ABOUT 600 AT ANY GIVEN TIME, ABOUT 600 VETERANS.

SO THIS COMPANY PROCESSES ALL OF THE, ALL OF THE HOURS, UH, AND THE, AND THE, UM, AND THEN INVOICES AND, AND PAYS THE EMPLOYEES FOR THE VETERANS THAT ARE CA PROVIDING THE CARE FOR THE VETERANS.

AND THEY CHARGE US ABOUT $115 TO DO THAT SERVICE PER EMPLOYEE.

BUT BECAUSE OF THE AMOUNT THAT'S PAID OUT, THAT'S WHAT JODY'S REFERRING TO, THE TOTAL AMOUNT THAT'S PAID OUT.

IT'S ROUGHLY THE 22 MILLION ANNUALLY? YES, SIR.

BUT IT'S 150.

DOES IT RELATED TO NEXT ITEM ON THE AGENDA.

SO, GREAT QUESTION.

UM, SO WE ARE, WITHOUT LOOKING IT TOO SOON, LOOKING AT, REPEAT THE QUESTION SO YOU CAN ANSWER IT.

OH, I'M SORRY.

BUT HERE, HERE'S YOU, HE ASKED HOW DOES THIS RELATE TO THE NEXT ITEM ON THE AGENDA WHERE WE'RE ASKING FOR AN RFP TO LOOK AT OTHER FMS OPTIONS? IT'S CURRENTLY, WE'VE BEEN WITH THE CURRENT CDS OF TEXAS SINCE 2013 AND WE ARE, ARE TRYING TO DO DUE DILIGENCE TO SEE WHAT ELSE IS OUT THERE, SO AT COST SAVINGS AND CAN ALSO ADVANCE OURSELVES TE TECHNOLOGY WISE WITH, UH, WITH ONLINE SERVICES SERVICES, UH, THAT WE CURRENTLY DON'T HAVE RIGHT NOW.

SO THE CURRENT, THE CONTRACT THAT CONSIDERING RIGHT NOW WOULD END WHEN AND WHEN WOULD THIS NEW ONE START? SO IT IS A ONE YEAR CONTRACT, ONE YEAR CONTRACT THAT WE'RE LOOKING TO RENEW.

HOWEVER, WE'RE LOOKING AT PUTTING OUT THE NEXT ONE, THE RRFP IN THE NEXT MONTH SO THAT WE CAN HAVE TIME IN THE NEXT COUPLE MONTHS TO TAKE A LOOK, LOOK AND FIGURE OUT IF THERE IS, THERE'S A BETTER DEAL OUT THERE FOR US AT ACOG WITHIN THE FINANCIAL MANAGEMENT SERVICE.

SO, SO BASICALLY WHAT YOU'RE SAYING IS THIS IS A ONE YEAR CONTRACT FOR US TO KEEP DOING THE GOOD THINGS THAT WE'RE DOING AND HAVING DONE WHILE WE SHOP FOR BETTER WAYS TO DO IT.

YES.

YES SIR.

AND THE CURRENT CONTRACT IS TERMINABLE ON 30 DAYS NOTICE.

SO IF WE DECIDE TO TERMINATE, WE CAN TERMINATE IT ON 30 DAYS NOTICE.

GOOD QUESTIONS.

ANYTHING ELSE? IS THERE A MOTION? MOTION TO APPROVE ITEM 20.

I SECOND.

OKAY, SECOND.

CAMACHO, CAMACHO GOT THE SECOND? YES.

OKAY.

GOT A MOTION AND A SECOND.

ANY DISCUSSION? THOSE IN FAVOR SAY AYE.

AYE.

AYE.

OPPOSED? MOTION CARRIES.

LET'S MOVE ON TO THE NEXT ITEM, WHICH WE'VE ALREADY INTRODUCED.

ITEM 21,

[21. Consider and act upon the recommendation to authorize the Executive Director to release a Request for Proposals (RFP) for a financial management services contractor in support of the Veterans Directed Care (VDC) program. This item does not require a budget amendment. - Juliet Gudgel]

WHICH IS TO CONSIDER AN ACT UPON THE RECOMMENDATION TO AUTHORIZE THE EXECUTIVE DIRECTOR TO RELEASE A REQUEST FOR PROPOSAL FOR A FINANCIAL MANAGEMENT SERVICES CONTRACTOR IN SUPPORT OF THE VETERANS DIRECTED CARE PROGRAM.

UH, THIS ITEM DOES NOT REQUIRE BUDGET AMENDMENT.

MS. K? YES, SIR.

SO, SO AS MENTIONED JUST A MOMENT AGO, WE'VE BEEN WITH OUR CURRENT PROVIDER, CDS OF TEXAS SINCE 2013.

SO WE WANT TO EXPLORE WHAT OPTIONS ARE OUT THERE, OUT THERE, AND BY ISSUING THIS OFFER, THIS RFP, WE'LL ENSURE A TRANSPARENT AND COMPETITIVE SELECTION PROCESS TO IDENTIFY THE MOST QUALIFIED CONTRACTOR TO MANAGE THE PAYROLL AND FINANCIAL OPERATIONS OF THE BDC PROGRAM.

AND THIS PROGRAM CONTINUES TO GROW EVERY YEAR.

SO ONCE AGAIN, WE WANNA MAKE SURE WE DO OUR, OUR DUE DILIGENCE AND FIND THE RIGHT CONTRACTOR TO CONTINUE PAYROLL FUNCTIONS AND MAINTAIN THE TRANSPARENCY AND AWARDING THE CONTRACT.

YES.

YES SIR.

AND THE RP PROCESS ALLOWS FOR THAT TRANSPARENCY.

SO MOVED.

SECOND, JUDGE LUTZ AND JUDGE CAMACHO.

MOTION IS SECOND.

UH, ANY DISCUSSION? THOSE IN FAVOR SAY AYE.

AYE.

OPPOSED? MOTION CARRIES.

THANK YOU.

MOVING ON

[22. Consider and act upon the recommendation to adopt a Resolution to recognize October 9, 2024, as Ageism Awareness Day in the AACOG Region. This item does not require a budget amendment. - Miguel Juarez.]

TO ITEM 22.

CONSIDER AN ACT UPON THE RECOMMENDATION TO ADOPT A RESOLUTION TO RECOGNIZE OCTOBER 9TH, 2024 AS AGEISM AWARENESS DAY IN THE ACOG REGION.

THIS ITEM DOES NOT REQUIRE BUDGET.

MR. JU NO, GO AHEAD.

GOOD MORNING, MR. CHAIRMAN.

I'M DEPUTY MR. HERBERT MEMBERS OF THE BOARD.

MY NAME IS MIGUEL JUAREZ.

I WORK AS THE MANAGER FOR, UH, AAA HERE AT ACOG.

IN RECOGNITION OF AGE ON OCTOBER 9TH, 2024, ACOG SEEKS TO BRING ATTENTION TO THE HARMFUL AND PERVASIVE EFFECTS OF AGEISM WITHIN OUR REGION.

RESEARCH HAS SHOWN THAT 82% OF ADULTS, 50 TO 80 YEARS YEARS OLD EXPERIENCE AGEISM, WHICH NEGATIVELY AFFECTS, UH, THEIR HEALTH, MENTAL WELLBEING, AND FINANCIAL STABILITY.

YES.

BY RAISING AWARENESS AND FOSTERING GENERATIONAL EQUITY, ACCO AND COMBAT AGEISM AND PROMOTE THE WELLBEING AND INCLUSION OF OLDER ADULTS, ACCO STAFF RE RECOMMENDS APPROVAL OF THIS RESOLUTION AS PRESENTED.

PENDING.

ANY QUESTIONS, SIR? THAT'S ALL I HAVE.

YOU MAKE THE MOTION? ANY DISCUSSION? WE HAVE A MOTION.

MAKE A MOTION.

OH, I GOT A LOT OF MOTIONS THERE.

HERE.

THE OLD GOT A LOT.

THE OLD GUARDS MAKING LOTS OF EMOTIONS.

YEAH, EXACTLY.

[01:15:01]

IDENTIFY WITH THAT.

OKAY.

JUDGE WHITMAN IS A MOTION 68.

SECOND IS, I'LL SECOND IT.

SECOND.

JUDGE LUTZ.

OKAY WITH THAT? ANY OTHER DISCUSSION? THOSE IN FAVOR SAY AYE.

AYE.

OPPOSED? MOTION CARRIES.

THANK YOU.

ANYTHING BUT LOSS MEMORY IN THERE? THINK WE CAN BE TO US.

ITEM 23, CONSIDER

[23. Consider and act upon the recommendation from the Resource Recovery Committee (RRC) to remove closed landfill U2761 from the AACOG Closed Landfill Inventory and authorize the Executive Director to submit the required Closed Municipal Solid Waste Landfill Inventory Revision Form to the Texas Commission on Environmental Quality (TCEQ). This item does not require a budget amendment. - Lyle Hufstetler]

AND ACT UPON THE RECOMMENDATION OF RESOURCE RECOVERY COMMITTEE TO REMOVE CLOSED LANDFILL U2 7 61 FROM THE ACOG CLOSED LANDFILL IN INVENTORY AND AUTHORIZE THE EXECUTIVE DIRECTOR TO SUBMIT THE REQUIRED CLOSED MUNICIPAL SOLID WASTE LANDFILL INVENTORY REVISION FORM TO THE TEXAS COMMISSION ON ENVIRONMENTAL QUALITY.

THIS ITEM WILL NOT REQUIRE AN AMENDMENT.

MS. EFF.

OKAY.

GOOD MORNING, EVERYBODY, EVERYBODY.

MY NAME'S LER.

I AM YOUR NATURAL RESOURCES PROJECT ADMINISTRATOR.

AND AMONG THIS MAY BEEN COVERED IN PREVIOUS MEETING, BUT AMONG THE ORGANIZATIONAL CHANGES IS TO MOVE THE ENVIRONMENTAL CONSERVATION UNDER MY PURVIEW, PURVIEW ON NATURAL RESOURCES.

SO THIS IS MY FIRST TIME PRESENTING, PRESENTING ANYTHING RELATED TO THAT DEPARTMENT.

SO PUT EASY ON ME PLEASE.

, JUST KIDDING.

YOU DON'T HAVE TO .

SO, UH, TRACK MANAGEMENT COMPANY LP HAS REQUESTED THAT LANDFILL Q2 76 1 BE REMOVED FROM THE CLO, THE AC CALL CLOSED LANDFILL INVENTORY.

THIS LANDFILL IS LOCATED, LOCATED AT 1322 MAMAN ROAD ROAD IN SAN ANTONIO, ANTONIO, TEXAS.

UH, IT'S IN BEAR COUNTY IN PRECINCT ONE, AND, UH, THE CITY OF SAN ANTONIO COUNCIL DISTRICT THREE.

AND I'M TOLD THAT, UH, TERRACON, WHO CONDUCTED THIS, UH, THIS STUDY TO, TO, TO ASSESS THE CONDITION OF THAT, UH, ALLEGED CLOSED LAND LANDFILL.

UM, I'M TOLD THAT HE DID REACH, REACH OUT TO COMMISSIONER CLAY FLORES'S OFFICE AND THE, UH, THE, THE COUNCILWOMAN FOR DISTRICT THREE.

I HAVE NOT MYSELF RECEIVED A, A CONFIRMATION FROM COMMISSIONER OR HER OFFICE OFFICE YET, SO I JUST WANTED TO MAKE SURE THAT I WAS TRANSPARENT ABOUT THAT.

UM, THE SITE UNDER CONSIDERATION IS A 400 500 ACRE SITE JUST NORTH OF THE TOYOTA PLANT ON THE SOUTH SIDE OF BEXAR COUNTY.

THE SUSPECTED LANDFILLS ABOUT 139 ACRES IN THE NORTHERN HALF.

SO, UH, EARLIER THIS YEAR, A PHASE ONE ENVIRONMENTAL SITE ASSESSMENT WAS PREVIOUSLY PERFORMED ON THIS SITE BY ADAMS AND ENVIRONMENTAL, AND THEY MARKED, UH, LOCATIONS OF FIVE DIFFERENT BITS THAT WERE PRESENT ON SITE AT THE TIME IN YOUR PACKET.

THAT'S A MAP OF THIS FACILITY.

IT'S NOTED WITH THE YELLOW DOTS STOCKPILE MATERIAL.

THOSE WERE ALSO NOTED, AND THOSE ARE RED CIRCLES IN THAT MAP.

AND THERE WERE ALSO, UH, OVER, UH, AERIAL IMAGERY OVER TIME REVEALED THAT THERE WERE SEVERAL GROUND DISTURBANCES AND THOSE ARE REFLECTED IN THE GREEN AREAS IN YOUR PACKETS.

SO THESE ARE THE AREAS WHERE TERRACON, UH, FOCUSED THEIR TESTING.

UH, AND, AND THE PHASE ONE ASSESSMENT, UH, ACTUALLY RECOMMENDED ADDITIONAL ANALYSIS, WHICH IS WHAT TERRACON WAS CALLED TO DO.

UH, AS PART OF THEIR ASSESSMENT.

THEY INCLUDED THAT IN THE EARLY NINETIES.

THIS WAS PRIMARILY AN AGRICULTURAL SITE, UN UNTIL THE EARLY NINETIES BEING USED AS A BORROW PIT TO EXCAVATE GRAVEL AND EXPAND AND SHIP IT OTHER LOCATIONS THAT NEEDED IT.

LIKEWISE, OTHER LOCATIONS WITHIN BRING THEIR WASTE, UH, WHICH WAS PRIMARILY SOIL, BUT, BUT THERE WAS SOME, UH, EVIDENCE OF ASPHALT AND CONCRETE IN THERE.

UH, TESTING BY TERRACON CONSISTED OF THE ACTIVITIES THAT ARE, THAT ARE ALSO LISTED IN YOUR PACKET.

UM, THERE, UM, THEY TESTED, TESTED FOR EIGHT, UH, RESOURCE CONSERVATION AND RECOVERY ACT, OR RETRO MATERIALS, INCLUDING LEAD AND OVER 140 VOLATILE ORGANIC COMPOUNDS.

THEY DID, UH, SOIL SAMPLES, SAMPLES AND GROUNDWATER SAMPLES.

SO THE SOIL SAMPLES, UM, UH, THEY CONCLUDED THAT THERE WERE NO, UH, PETROLEUM BASED HYDROCARBONS PRESENT.

UH, THERE WERE NO, UH, VOLATILE ORGANIC COMPOUNDS DETECTED.

THERE WAS EGG DETECTED IN SOME OF SOME OF THE GROUND, UH, THE, UH, CORE SAMPLES THAT WERE ABOVE THE TEXAS SPECIFIC MEDIAN BACKGROUND CONCENTRATION ESTABLISHED BY THE PCP, BUT THEY'RE WELL BELOW THE THRESHOLD FOR, FOR, UH, HARMFUL DIRECT HUMAN MINUTES.

JUST TO PUT A NUMBER ON IT.

UH, THEY WERE, THESE WERE 23 AND 33 MILLIGRAMS PER MILLIGRAM.

THE THRESHOLD FOR A FEW MINUTES EXPOSURE IS 500.

SO, OH, BELOW THAT THRESHOLD, THE, UH, RESOURCE RECOVERY COMMITTEE CHAIR DID BRING UP SOME AERIAL IMAGERY THAT, THAT SHOWED SOME SUSPECTED OIL SPOTS ON THE SURFACE THAT WERE PRESENT, PRESENT.

BUT ONCE TE TERRACON GOT ON SITE THAT THERE WAS NO EVIDENCE EVIDENCE OF THAT.

SO, UH, IT WAS ASSESSED THAT THAT ADAMS HAD REMEDIATED THOSE ISSUES.

UH, THE, THE, THE ASPHALT THAT WAS, THAT WAS A PART OF THE, THE STOCKPILE OF MATERIALS, UH, THAT'S THE SOURCE OF, OF, OF, OF, YOU KNOW, ANY MINOR, UM, CON CONCENTRATIONS OF, OF, OF, UM, UM, HYDRO CARBON AND OTHER POLLUTANTS.

AS FAR AS THE GROUNDWATER,

[01:20:01]

THE ONLY VOLATILE ORGANIC COMPOUND DETECTED WAS TOINE, AND IT WAS EXTREME, EXTREMELY LOW.

IT'S, UH, BASICALLY ENOUGH TO BE DETECTED, BUT NOT ENOUGH TO ACCURATELY MEASURE.

SO THE BOTTOM LINE IS ALL CHEMICALS, UH, WERE BELOW THE, UH, HEALTH BASED STANDARD AND, UH, THE VOLUME OF METH, METHANE PRODUCING WASTE WAS BELOW THE DIMEN THRESHOLD.

AND ULTIMATELY TERRACON DID NOT NECESSARILY EVIDENCE OF A LANDFILL JUST OF HAVING ALLOWED SOIL, SOIL BEING BROUGHT IN TO BE USED AS A, WHICH MAY BE A VERY BASIC DEFINITION, LANDFILL, BUT IT WAS NEVER PERMITTED AS A LANDFILL.

SO, UH, TERRACON HAD, UH, RECOMMENDED REMOVAL OF U2 76 1 FOR, FROM THE CLOSED LANDFILL INVENTORY AT THE RESOURCE RECOVERY COMMITTEE MEETING, THEY GAVE THEIR PRESENTATION ON, ON SEPTEMBER 11TH.

AND THE COMMITTEE THEN CONCLUDED THAT THE INFORMATION THAT THEY PROVIDED HIGHLY DEMONSTRATED THAT THE PROPERTY COULD BE REMOVED FROM THE CLOSED LANDFILL.

SO THERE'S A PRESENTATION, UH, AGENDA PACKET, WHICH EXACTLY WHAT TERRACON HAD PRESENTED EARLIER THIS MONTH.

SO, UH, TASK BEFORE YOU IS TO, UM, APPROVE THE RECOMMENDATION OF THE RRC OR GIVEN THAT, UM, YOU KNOW, I HAVE NOT MYSELF CONFIRMED CORRESPONDENCE BETWEEN TERRACON AND THE, UH, THE COMMISSIONER AND COUNSEL PERSON OVERSEEING THAT DISTRICT.

IT'S UP TO Y'ALL.

UM, WITH COMMISSIONER CLAY FLORES'S OFFICE, I'M THE CHIEF OF STAFF.

UM, WE HAVE NO CONCERNS.

WE'RE OKAY.

I THINK, I BELIEVE MARCUS PRIM WAS WORKING ON THIS PROJECT.

UM, UNFORTUNATELY MARCUS IS GONNA BE OUT FOR AT LEAST THE NEXT TWO MONTHS.

UM, BUT HE, YEAH, UH, UH, BUT YEAH, WE DON'T, I, UH, I DON'T THINK HE HAD AN OPPORTUNITY TO BRIEF THE COMMISSIONER BEFORE HE STEPPED OUT, BUT I DON'T SEE, I DON'T REMEMBER MARCUS SAYING THAT THERE WAS ANY ISSUES WHEN HE MET WITH THEM.

OKAY, GREAT.

THANK YOU FOR THAT.

SO, SO THE, THE, THE BOARD KNOWS, UH, CLIFF HAS IMPLEMENTED A POLICY TO, UH, RUN THESE TYPES OF THINGS BY THE ELECTED OFFICIALS THAT ARE, ARE DIRECTLY AFFECTED.

UH, AND IF YOU'RE UNCOMFORTABLE, BECAUSE WE HAVEN'T HAD THE CONFIRMATION FROM THE CITY COUNCIL PERSON, AND YOU MAY NEED TO CONFIRM, UH, YOUR INFORMATION, UH, WE CAN TABLE THIS TILL NEXT MONTH.

UH, HISTORICALLY WE HAVE NOT DONE THAT.

I WOULD PREFER, I THINK THAT IS A VERY WE TABLE, JUST SO THAT IT GIVES ME AN OPPORTUNITY TO BE ABLE TO SPEAK TO TERRA, UH, TO TERRACON MYSELF AND THEN SPEAK TO THE COMMISSIONER.

I SO MOVE TABLE IT? YES.

OKAY.

WE'VE GOT A MOTION TO TABLE A SECOND.

ACTION.

MOTION.

LEMME ASK A QUESTION.

IS THERE A TIME CERTAIN ON THIS THAT, THAT NEEDS TO BE ACTED UPON? NOT THAT I'M AWARE OF.

UM, I CAN FIND OUT, BUT I CAN'T IMAGINE.

UM, AND, AND GO AHEAD.

AND, AND WHAT ARE THEY GOING TO DO WITH THIS PROPERTY? BECAUSE THIS IS IN THE AREA WHERE WE'VE HAD A BIG ZONING HOOP PLOW OVER THERE BY THE TOYOTA PLANT.

UM, I DON'T HAVE ANY INSIGHT, INSIGHT INTO THEIR INTENDED SPECIFIC USE, BUT I DO KNOW, KNOW THAT IT'S, IT'S RELATED TO THAT CONDOS.

CONDOS, NO.

A JOKE.

AND I THINK THE ISSUE REGARDING WHETHER WE PASS THIS FOR THIS, UH, TODAY OR TAKE IT UP NEXT, NEXT MEETING, UH, IS, IS WHETHER WE WANT TO GET CON CONFIRMATION FROM THE ELECTED OFFICIALS THAT ARE INVOLVED IN THIS.

OH, NO, WE SHOULD.

I, I THINK I PERSONALLY THINK THAT'S A VERY GOOD POLICY THAT YOU'VE IMPLEMENTED.

UH, THANK YOU.

SO, BECAUSE THEY KNOW MORE THAN WE, SO I, I, I SUPPORT US TABLING THIS UNTIL AT LEAST, UH, THE PERSONS THAT ARE DIRECTLY INVOLVED IN IT ARE HERE AT THIS TABLE.

UNLESS THERE WAS SOMETHING TIME SENSITIVE ABOUT IT.

RIGHT.

WHICH IT DOESN'T APPEAR TO BE NOT AWARE OF.

I'M SENSITIVE NATURE.

SO TABLE IT TILL THE NEXT MEETING.

YEAH.

YES, SIR.

OKAY.

THERE'S A MOTION TO SECOND IT.

EVERYBODY THAT'S IN FAVOR OF THAT, SIR, GO AHEAD.

VOTING ON WHETHER TO TABLE OR NOT.

WELL, YEAH, I KNOW.

YES, BUT THERE'S A MOTION IN THE SECOND TO TABLE.

OPPOSED IN FAVOR, SAY AYE.

AYE.

AYE.

OPPOSED? MOTION CARRIES.

TAKE THAT UP.

NEXT MEETING.

CAN I ASK WHO MADE THE MOTION? THANK YOU.

THANK YOU.

OKAY, THANK YOU.

OUR DEPARTMENT IS ACTUALLY UNDER, UM, WHAT WE CALL THE, UH, WE HAVE A GROUP, SO WE, SO WE HAVE AGING WEATHERIZATION AND BUILDING VETERANS AFFAIRS.

SO TOGETHER WE USE ALL THREE PROGRAMS TO SEND INFORMATION THAT MILITARY VETERANS AFFAIRS WORKS WITH.

ALL THE VETERAN SERVICE OFFICES? YES, SIR.

OUR INFORMATION, IF I MAY, I WAS GONNA SAY, MAYOR, ONE OF THE THINGS TOO IS LIKE IF SOMEONE CALLS INTO OUR, UM, ALAMO SERVICE CONNECTION, THEY IDENTIFY A NEED, WE TRY TO DIRECT THEM WITHIN THE ORGANIZATION TO AVAILABLE SERVICES.

SO I TRY TO GET THE WORD, I LIKE TO JUST OFFER UP WAYLAND UNIVERSITY, WHICH IS IN LINE THOUGH.

THEY HAVE A VETERANS AFFAIRS OFFICE THERE.

AND I'D LIKE TO JUST MAKE SURE THAT THEY KNOW ABOUT THAT PROGRAM.

WE WILL BE.

THANK YOU.

ITEM 27,

[27. Consider and act upon the recommendation to authorize the Executive Director to apply for and accept 5339 Discretionary Funds in an approximate amount of $2,300,000 for fleet replacement. This item does not require a budget amendment. - Duane Evans]

CONSIDER AND ACT UPON THE RECOMMENDATION TO AUTHORIZE THE EXECUTIVE DIRECTOR TO APPLY FOR AND ACCEPT 53 39 DISCRETIONARY FUNDS AND APPROXIMATE AN APPROXIMATE AMOUNT OF $2,000,300 FOR FLEET REPLACEMENT.

THIS ITEM DOES NOT REQUIRE BUDGET AMENDMENT.

YES, SIR.

GOOD MORNING, MR. EVAN.

MR. EVANS MEMBERS TO THE BOARD NAME DWAYNE EVAN.

I'M DIRECTOR OF TRANSPORTATION COUNCIL AREA COUNCIL OF GOVERNMENTS.

LAST YOU APPROVE A POWER TO APPLY FOR ACCEPT 53 39 FUNDING FOR 18 REPLACEMENT VEHICLES.

THIS ITEM IS SUPPLIED FOR AND ACCEPT ADDITIONAL 53 30 39 FUNDING FROM TEDO TO PURCHASE 14 LOW EMISSION REPLACEMENT TRANSIT VEHICLES.

OUR PRIMARY NEED AT THIS TIME IS UPGRADE ALL THE REVENUE VEHICLES, UM, TO NEWER ONES THAT ARE MORE EFFICIENT AND LESS LIKELIHOOD, EXCUSE ME, LESS COST, LESS COSTLY TO MAINTAIN.

THIS WILL NOT REQUIRE COMMIT TO THE 2024 BUDGET.

IF THERE ARE ANY QUESTIONS, I CAN, I CAN ANSWER NOW.

MAD DENNIS.

I THANK YOU MR. CHAIR.

THANK YOU.

MR. EVANS, WHAT HAPPENS TO THOSE VEHICLES ONCE YOU GET THEM OUT OF SERVICE? I MEAN, WHERE DO THEY GO? UM, NORMALLY ONCE, ONCE WE ARE, UM, PAST THE USEFUL LIFE OF A VEHICLE, WE'RE ABLE TO, UM, AUCTION THEM.

OKAY.

SO WE NORMALLY, UM, AUCTION VEHICLES AND WE RETURN THAT MONEY TO, TO THE PROGRAM AND UTILIZE IT, UM, MOST RESPONSIBLE WAY POSSIBLE.

ALL RIGHT, THANK YOU.

YES MA'AM.

THANK YOU MR. CHAIR.

ANY OTHER QUESTIONS, MR. CHAIR? YES.

UH, CAN YOU JUST SPEAK TO THE, THE TYPES OF VEHICLES? IT LOOKS LIKE PRETTY EXPENSIVE, NOT TYPICAL.

UH, LIGHT DUTY VEHICLES.

THESE ARE TRANSIT VEHICLES? YES, THESE ARE TRANSIT VEHICLES.

WE'RE GONNA BE, UM, LOOKING AT, UM, PROPANE VEHICLES.

THAT'S GONNA BE OUR, UM, CHOICE AT THIS TIME BASED ON WHAT TECH STOCK IS.

UM, KIND OF DIRECTING US TO DO WHAT WHAT SIZE? I'M SORRY.

SIZE.

UM, THEY'RE GONNA BE, UM, THE NORMAL, WE'RE LOOKING AT BETWEEN, BETWEEN 12 TO 15 PASSENGER, UM, TYPE TWO CUT, TYPE TWO CUTAWAYS.

UM, TYPE TWO CUTAWAY IS, UM, THE NORMAL TRANSIT VEHICLE WE USE.

UM, A DA ACCESSIBLE WITH THE WHEELCHAIR LIFT, THINGS OF THAT NATURE.

THAT ANSWER YOUR QUESTION? ANY OTHER QUESTIONS? ONE, WHAT'S YOUR AVERAGE VEHICLE LIFECYCLE? UM, ISH ? UM, NORMALLY 150,000 MILES AND, UM, THAT'S NORMALLY BETWEEN THREE TO FIVE YEARS.

GOT IT.

UM, SOMETIMES THEY'RE MILES ADD UP A LITTLE QUICKER BASED ON THE USE, BUT THAT'S THE NORMAL LIFESPAN.

THANK YOU.

YES, MA'AM.

I HAVE ONE QUESTION.

YES SIR.

UH, ART HAS LARGER BUSES.

I KNOW, UH, SINE HAS SOME OF THOSE AND THERE'S, THERE'S ONE I THINK IN KERRVILLE.

OKAY.

OR ARE THEY ON THIS SCHEDULE OR ARE THEY GONNA BE REPLACED AT A LATER DATE? WELL, UM, A LARGE, UM, THE BIGGEST THING ARE LARGE VEHICLES.

UM, WE DON'T NORMALLY CARRY PASSENGER, UM, COUNTS OF 28 TO 32 PEOPLE ONLY ON SPECIAL OCCASIONS.

SO AS YOU KNOW, THE MILEAGE IS NOT ACCUMULATING ON THOSE FAST.

SO WHAT WE'RE GONNA DO IS WE CONTINUE TO UTILIZE THEM FOR SPECIAL SERVICES AND THINGS OF THAT NATURE.

OUR MIND IS MOVING UP AND ONCE WE GET TO THAT ONE 50, UM, IN TERMS OF A THOUSAND MILES, WE'RE GONNA GO AHEAD TO AUCTION THOSE AS WELL.

BUT IT'S JUST A LITTLE BIT LONGER BECAUSE THE USE OF THOSE AREN'T AS MUCH AS OKAY.

SO THEY'RE NOT PART OF THIS LIST? NO, THEY'RE BE PART OF THIS.

ALRIGHT.

ANY OTHER QUESTIONS? MOTION TO APPROVE A SECOND.

BRADLEY AND DENNIS, ANY OTHER DISCUSSION? THOSE IN FAVOR SAY AYE.

AYE.

OPPOSED? MOTION CARRIES.

THANK YOU.
